5.36.010 <br />(Pleasanton Supp. No. 28, 7-22) 114 <br />Chapter 5.36 <br /> <br />TRI-VALLEY TOURISM BUSINESS <br />IMPROVEMENT DISTRICT <br /> <br />Sections: <br />5.36.010 Established. <br />5.36.020 Boundaries. <br />5.36.030 Amendments to state law. <br />5.36.040 Purpose. <br />5.36.050 Assessments. <br />5.36.060 Benefit. <br />5.36.070 Power to contract. <br />5.36.080 Collection of assessments. <br />5.36.090 Bonds. <br /> <br />5.36.010 Established. <br /> There is established in the cities of Pleasanton, <br />Dublin, and Livermore, the town of Danville, and the <br />counties of Alameda and Contra Costa the Tri-Valley <br />Tourism Marketing District (“the district”), under the <br />provisions of the Property and Business Improvement <br />District Law of 1994, as set forth in the Streets and <br />Highways Code of the state, Section 36600 et seq. (Ord. <br />2237 § 1, 2022; Ord. 2119 § 1, 2015; Ord. 2004 § 1, <br />2010; Ord. 1929 § 1, 2006) <br /> <br />5.36.020 Boundaries. <br /> The boundaries of the district shall be the corpo- <br />rate limits of the cities of Pleasanton, Dublin and Liver- <br />more, and the town of Danville, as such corporate limits <br />are amended from time to time, and designated areas of <br />the counties of Alameda and Contra Costa as described <br />in the Management District Plan. (Ord. 2237 § 1, 2022; <br />Ord. 2119 § 1, 2015; Ord. 2004 § 1, 2010; Ord. 1929 § <br />1, 2006) <br /> <br />5.36.030 Amendments to state law. <br /> The businesses and operation of the district shall <br />be subject to any amendments to the Property and Busi- <br />ness Improvement District Law of 1994, as amended. <br />(Ord. 2004 § 1, 2010; Ord. 1929 § 1, 2006) <br /> <br />5.36.040 Purpose. <br /> The purposes for which the assessments collected <br />under this chapter shall be used are the statutory pur- <br />poses set forth in Section 36600 et seq., of the Streets <br />and Highways Code of the state, or one or more of the <br />following purposes: <br /> A. Sales and marketing programs and activities <br />designed to attract overnight groups; <br /> B. Communications and public relations activi- <br />ties and services to build greater awareness of Tri- <br />Valley businesses and the Tri-Valley region as a tour- <br />ism, meeting, and event destination; <br /> C. Administrative costs and operation. <br /> The improvements and activities to be provided in <br />the district will be funded by the levy of the assess- <br />ments. The revenue from the levy of assessments within <br />the district shall not be used to provide services outside <br />of the district, or for any purpose other than the purposes <br />established herein and in the resolution of intention. <br />(Ord. 2004 § 1, 2010; Ord. 1929 § 1, 2006) <br /> <br />5.36.050 Assessments. <br /> All lodging businesses available for public occu- <br />pancy within the boundaries of the district shall be sub- <br />ject to an assessment based upon $3.25 per paid occu- <br />pied room per night, with a possible increase in the as- <br />sessment beginning in year three of up to a maximum of <br />$4.00 per paid occupied room per night. Stays of 30 <br />consecutive days or more or stays by any Federal or <br />State of California officer or employee when on official <br />business who makes a claim that they are exempt or <br />stays by any officer or employee of a foreign govern- <br />ment who is exempt by reason of express provision of <br />federal law or international treaty shall not be assessed. <br />(Ord. 2237 § 1, 2022; Ord. 2119 § 1, 2015; Ord. 2004 § <br />1, 2010; Ord. 1929 § 1, 2006) <br /> <br />5.36.060 Benefit. <br /> The city council finds that the lodging businesses <br />within the district will be benefitted by the improve- <br />ments and activities funded by the assessment levied. <br />(Ord. 2004 § 1, 2010; Ord. 1929 § 1, 2006) <br /> <br />5.36.070 Power to contract. <br /> The council may contract from time to time with a <br />nonprofit tax exempt corporation, the purpose of which <br />shall be to carry out the purposes for which the assess- <br />ments are levied and provided in this chapter. In the <br />event such agreement is made, it shall provide that the <br />corporation shall present a budget of proposed expendi- <br />tures and purposes to the city manager for investigation <br />and report to the council upon the advisability and feasi- <br />bility of the proposed expenditures and improvements. <br />Upon approval of the budget requests, the council shall <br />allocate and direct payment of such amounts as it shall <br />determine to the contracting agency by the city finance <br />office. The Tri-Valley convention and visitors bureau <br />shall be designated as the contracting agency. (Ord. <br />2004 § 1, 2010; Ord. 1929 § 1, 2006) <br />
