18.124.290 <br /> 713 (Pleasanton Supp. No. 28, 7-22) <br />18.124.290 Denial—New application. <br />Following the denial of a minor conditional use permit application or the revocation of a minor conditional use <br />permit, no application for a use permit for the same or substantially the same conditional use on the same or substan- <br />tially the same site shall be filed within one year from the date of denial or revocation of the minor conditional use <br />permit. (Ord. 2155 § 3, 2017) <br /> <br />18.124.300 Use permit to run with land. <br />A minor conditional use permit granted pursuant to the provisions of this chapter shall run with the land and shall <br />continue to be valid upon a change of ownership of the site or structure which was the subject of the use permit applica- <br />tion. (Ord. 2155 § 3, 2017) <br /> <br />18.124.310 Design review. <br />All uses subject to a minor conditional use permit shall be subject to design review as prescribed in Chapter <br />18.20 of this title. Applicants are advised to confer with the zoning administrator before preparing detailed plans. (Ord. <br />2155 § 3, 2017) <br /> <br />Article IV. Conditional Use Permits for Small Bed and Breakfasts and Bed and Breakfast Inns <br /> <br />18.124.390 Procedure. <br />Applications for small bed and breakfasts and bed and breakfast inns shall be processed in accordance with Arti- <br />cle I of this chapter. <br />In addition to the findings listed in Section 18.124.070 of this chapter, the planning commission shall make the <br />following finding before granting of a use permit for a small bed and breakfast in an R-1 district: The proposed location <br />of the small bed and breakfast will not change the residential character of the neighborhood due to an overconcentration <br />of small bed and breakfasts or other home business establishments in the area. (Ord. 2155 § 3, 2017; Ord. 1636 § 10, <br />1994) <br /> <br />18.124.400 Standards. <br />A. Small bed and breakfasts shall be owner occupied. Bed and breakfast inns shall be owner occupied or shall pro- <br />vide for a resident manager. <br />B. Meal service shall be limited only to residents and overnight guests, except that in the C-C district, a restaurant <br />may be approved as part of the use permit for a bed and breakfast inn. <br />C. No receptions, banquets, or other commercial gatherings shall be permitted unless approved as part of the use <br />permit for a bed and breakfast inn in the C-C district. <br />D. Small bed and breakfasts and bed and breakfast inns shall conform to the requirements of the county health de- <br />partment, the uniform building code, and Title 24 of the California Administrative Code. <br />E. Parking shall be provided on-site as provided in Sections 18.88.030 and 18.88.040 of this title. (Ord. 2155 § 3, <br />2017; Ord. 1636 § 10, 1994)
