ATTACHMENT 1 <br /> ORDINANCE NO. <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON CREATING <br /> CHAPTER 20.75 OF THE PLEASANTON MUNICIPAL CODE REGARDING <br /> UNIVERSAL DESIGN IN NEW SINGLE-FAMILY, DUPLEX AND TRIPLEX <br /> RESIDENTIAL DEVELOPMENT <br /> WHEREAS, in 2020, according to the United States Census, 7.5-percent of the residents <br /> of Pleasanton not living in an institutional setting had a disability, and for the population over 65 <br /> years of age, 29.5-percent had a disability, which may include any hearing, vision, cognitive, <br /> ambulatory, self-care and independent living difficulty; and <br /> WHEREAS, such disabilities can affect the ability of an individual to live independently in <br /> conventional residential setting, or to visit the homes of others. Individuals with mobility and other <br /> disabilities may require special accommodations to their homes to continue to live independently, <br /> or to "age in place"; and <br /> WHEREAS, the proposed amendments to the Pleasanton Municipal Code are reasonably <br /> necessary to enhance the full life-cycle use of housing without regard to the physical abilities or <br /> disabilities of a home's occupants or guest, and in order to accommodate a wide range of <br /> preferences and physical abilities; and <br /> WHEREAS, the proposed amendments to the Pleasanton Municipal Code are <br /> substantially the same as the model universal design ordinance adopted by the Department of <br /> Housing and Community Development; <br /> WHEREAS, on July 27, 2022 the Planning Commission held a duly-noticed public hearing <br /> and considered relevant exhibits, recommendations of the City staff, received testimony from the <br /> public, and provided a favorable recommendation with changes to staff's recommendation, <br /> regarding the proposed amendments to the Pleasanton Municipal Code; and <br /> WHEREAS, the proposed code amendments are not considered a project under Division <br /> 13 (commencing with Section 21000) of the Public Resources Code and are categorically exempt <br /> per CEQA Guidelines Section 15303. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Approves creation of new Chapter 20.75 of the Pleasanton Municipal Code <br /> regarding universal design in new single-family, duplex and triplex residential development, as <br /> shown in Exhibit A to this ordinance. <br /> SECTION 2. A summary of this ordinance shall be published once within fifteen (15) days <br /> after its adoption in "The Valley Times," a newspaper of general circulation published in the City <br /> of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's <br /> office within fifteen (15) days after its adoption. <br /> SECTION 3. This ordinance shall be effective thirty (30) days after its passage and <br /> adoption. <br />
