13 <br /> THE CITY OF <br /> _ CITY COUNCIL AGENDA REPORT <br /> pLEASANTON <br /> September 20, 2022 <br /> Community Development <br /> TITLE: INTRODUCE AN ORDINANCE CREATING CHAPTER 20.75 OF THE <br /> PLEASANTON MUNICIPAL CODE REGARDING UNIVERSAL DESIGN IN <br /> NEW SINGLE-FAMILY, DUPLEX AND TRIPLEX RESIDENTIAL <br /> DEVELOPMENT; AND DIRECT STAFF TO AMEND ACCESSIBILITY <br /> CONDITIONS OF APPROVAL FOR MULTI-FAMILY RESIDENTIAL <br /> DEVELOPMENT <br /> SUMMARY <br /> As part of the FY 2021/22 - FY 2022/23 work plan, the City Council directed <br /> consideration of amendments to City standards and codes to enhance accessibility and <br /> universal design in multi-family residential development. On April 19, 2022, the City <br /> Council reviewed possible approaches to accomplish this goal and provided direction to <br /> staff to proceed with developing local municipal code amendments. Based on the <br /> requirements of State law with respect to local amendments to the California Building <br /> Code (CBC), which encompasses the requirements for accessibility in new multifamily <br /> residential construction, the City is limited in the extent to which it can impose <br /> accessibility requirements that are more stringent than the CBC. However, opportunities <br /> exist to strengthen such requirements for certain types of residential developments, and <br /> to improve an existing condition of approval related to accessibility that has been <br /> negotiated for all recent large multi-family projects. The proposed draft ordinance and <br /> enhanced conditions of approval reflect this approach and the outcomes of the City <br /> Council's April discussion and direction. <br /> RECOMMENDATION <br /> 1. Find that the proposed amendments to the Pleasanton Municipal Code (PMC), <br /> comprising a new Chapter 20.75 Universal Design, are not considered a project <br /> under Division 13 (commencing with Section 21000) of the Public Resources Code <br /> and are categorically exempt from the California Environmental Quality Act (CEQA) <br /> pursuant to Section 15303; and <br /> 2. Introduce the draft ordinance, find the subject code amendments consistent with the <br /> General Plan, and the amendments to the PMC as shown in Attachment 1; and <br /> 3. Direct staff to amend the accessibility conditions of approval for multi-family <br /> residential development. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City is anticipated with the subject amendments to the PMC. <br />
