13
THE CITY OF
_ CITY COUNCIL AGENDA REPORT
pLEASANTON
September 20, 2022
Community Development
TITLE: INTRODUCE AN ORDINANCE CREATING CHAPTER 20.75 OF THE
PLEASANTON MUNICIPAL CODE REGARDING UNIVERSAL DESIGN IN
NEW SINGLE-FAMILY, DUPLEX AND TRIPLEX RESIDENTIAL
DEVELOPMENT; AND DIRECT STAFF TO AMEND ACCESSIBILITY
CONDITIONS OF APPROVAL FOR MULTI-FAMILY RESIDENTIAL
DEVELOPMENT
SUMMARY
As part of the FY 2021/22 - FY 2022/23 work plan, the City Council directed
consideration of amendments to City standards and codes to enhance accessibility and
universal design in multi-family residential development. On April 19, 2022, the City
Council reviewed possible approaches to accomplish this goal and provided direction to
staff to proceed with developing local municipal code amendments. Based on the
requirements of State law with respect to local amendments to the California Building
Code (CBC), which encompasses the requirements for accessibility in new multifamily
residential construction, the City is limited in the extent to which it can impose
accessibility requirements that are more stringent than the CBC. However, opportunities
exist to strengthen such requirements for certain types of residential developments, and
to improve an existing condition of approval related to accessibility that has been
negotiated for all recent large multi-family projects. The proposed draft ordinance and
enhanced conditions of approval reflect this approach and the outcomes of the City
Council's April discussion and direction.
RECOMMENDATION
1. Find that the proposed amendments to the Pleasanton Municipal Code (PMC),
comprising a new Chapter 20.75 Universal Design, are not considered a project
under Division 13 (commencing with Section 21000) of the Public Resources Code
and are categorically exempt from the California Environmental Quality Act (CEQA)
pursuant to Section 15303; and
2. Introduce the draft ordinance, find the subject code amendments consistent with the
General Plan, and the amendments to the PMC as shown in Attachment 1; and
3. Direct staff to amend the accessibility conditions of approval for multi-family
residential development.
FINANCIAL STATEMENT
No fiscal impact to the City is anticipated with the subject amendments to the PMC.
