CITY COUNCIL, CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 449 <br /> <br /> AMENDING ORDINANCE NO. 341 (ENCROACHMENTS <br /> UPON PUBLIC STREETS), BY CHANGING REQUIRE- <br /> MENTS CONCERNING MAIL BOXES <br /> <br /> The City Council of the City of Pleasanton does hereby <br />ordain as follows: <br /> <br /> SECTION 1. Ordinance No. 341, adopted February 26, 1962, <br />concerning regulation of encroachments upon the public streets <br />and right of ways, is hereby amended, by changing Section 3021 <br />to read as follows: <br /> <br /> ~'3021. MAIL BOXES. No mail box shall be placed <br /> within the right of way of the public road or <br /> street so as to endanger the life and safety of <br /> the traveling public. Permits shall be re- <br /> quired for the placing of mail boxes .7, <br /> <br /> SECTION 2. (a) This ordinance is an emergency measure to <br />become effective immediately upon adoption by an affirmative vote <br />of four-fifths of the City Council <br /> <br /> (b) The City Council does hereby ordain that this <br />measure requires use of its emergency powers for the preservation <br />of the public health, safety and welfare of the people of the <br />City, based upon findings of fact as follows: <br /> <br /> 1) Zoning districts to regulate land use under <br /> the police power of the City require consideration of <br /> use of public rights-of-way which has been dedicated <br /> to the City. <br /> <br /> 2) Esthetics, traffic problems and use of City <br /> prop,erty are properly subject to City control in the <br /> City s attempt to :create neighborhoods and living <br /> areas for its citizens in keeping with the Zoning <br /> Ordinance, the General Plan and the Encroachment <br /> Or d inanc e. <br /> <br /> 3) The recent regulations adopted by the Post- <br /> master of the United States of America, providing <br /> for placing of mail boxes within the public right- <br /> of-way, does effectively defeat the City's policy and <br /> objectives, as expressed in said General Plan, Zoning <br /> Ordinance and Encroachment Ordinance. <br /> <br /> 4) The new enforcement of Postal Regulations <br /> does undermine the City policy, and defeats the City' s <br /> use of its police power, all to the detriment of the <br /> health, safety and welfare of the public. <br /> <br /> INTRODUCED at a regular meeting of the City Council of the <br /> City of Pleasanton on April 4, 1966. <br /> <br /> - 1 - <br /> <br /> <br />
