Attachment 1 RESOLUTION NO. 22- A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON FORMALLY ACKNOWLEDGING THE INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS, LOCAL 1974 AS THE EXCLUSIVELY RECOGNIZED EMPLOYEE ORGANIZATION FOR THE LIVERMORE-PLEASANTON FIRE DEPARTMENT JOINT POWERS AUTHORITY'S FULL-TIME BATTALION CHIEFS WHEREAS, in compliance with Government Code Section 3507 (Exhibit A), the City of Pleasanton through the Livermore -Pleasanton Fire Department Joint Powers Authority (LPFD JPA) has adopted reasonable rules and regulations for the administration of employer-employee relations which are set forth in the LPFD JPA Employer -Employee Relations Procedure; and WHEREAS, pursuant to the LPFD JPA's Employer -Employee Relations Procedure, the International Association of Fire Fighters (IAFF), Local 1974, AFL -CIO -CLC filed a valid recognition petition requesting to be recognized as the exclusively recognized employee organization for a bargaining unit consisting solely of the LPFD JPA's full-time Battalion Chiefs; and WHEREAS, the Municipal Employee Relations Officer determined the proposed bargaining unit was an appropriate unit in accordance with Article II, Section 10 (b) and Article II, Section 14 of the LPFD JPA's Employer -Employee Relations Procedure (Exhibit B); and WHEREAS, the LPFD JPA verified that the IAFF, Local 1974 demonstrated majority support in the bargaining unit consisting solely of the LPFD JPA's full-time Battalion Chiefs as required in Article ll, Section 9, paragraph 10 and Article II, Section 10 of the LPFD JPA's Employer -Employee Relations Procedure (Exhibit B); and WHEREAS, the IAFF, Local 1974 received signed authorization cards from all the LPFD JPA's full-time Battalion Chiefs designating IAFF, Local 1974 as the exclusive representative of a unit consisting solely of the LPFD JPA's full-time Battalion Chief's in their employment relations with the LPFD JPA; and WHEREAS, the City Council desires to formally acknowledge the International Association of Fire Fighters, Local 1974, as the exclusively recognized employee organization for the LPFD JPA's full-time Battalion Chiefs. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: The formal acknowledgement of the International Association of Fire Fighters (IAFF), Local 1974 as the exclusive representative for the Livermore -Pleasanton Fire Department Joint Powers Authority's (LPFD JPA) full-time Battalion Chiefs. As described herein, the Municipal Employee Relations Officer verified receipt of one valid recognition petition. No other petitions were filed during the open period for filing intervening petitions. The Livermore -Pleasanton Fire Department Joint Powers Authority verified unanimous authorization cards from the full-time Battalion Chiefs designating the IAFF, Local 174 as their exclusive representative. Having satisfied all requirements to secure formal recognition according to LPFD JPA Employer - Employee Relations Procedure and Government Code Section 3507, the IAFF, Local 1974 is recognized as the representative for the LPFD JPA's full-time Battalion Chiefs' bargaining unit.
