ORDINANCE NO. 2239 <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> AMENDING THE MUNICIPAL CODE REGARDING ADMINISTRATIVE CITATION <br /> PROCEDURES, ADMINISTRATION AND PERSONNEL, BUSINESS LICENSE <br /> APPEALS, ANIMALS, PARKING, ACTIVITIES IN PARKS, METER TESTING AND <br /> TITLES 17 AND 18 PLANNING AND ZONING <br /> WHEREAS, the Pleasanton Municipal Code regularly needs to be updated to reflect <br /> changes in State law and actual practices; and <br /> WHEREAS, City staff are not always able to be present to witness code violations. and <br /> the practice has been to allow persons to sign administrative citations at the reasonable discretion <br /> of staff. and appear at hearings as witnesses; and <br /> WHEREAS. the California constitution (article XI, §10(b)) prohibits cities from requiring <br /> employees to live within city limits: and <br /> WHEREAS, appeals of the application of the Municipal Code, except for zoning matters, <br /> are typically heard by an administrative hearing officer, City Manager or Chief of Police, and not <br /> the City Council, therefore business license appeals will be heard by an administrative hearing <br /> officer; and <br /> WHEREAS, the Police Department's practice regarding animals at large involves the <br /> exercise of discretion by the Animal Services Officer; and <br /> WHEREAS, the limit on the length of vehicles parked on public streets needs to be <br /> amended for current longer extended cab non-commercial types of passenger trucks; and <br /> WHEREAS, the prohibition regarding advertising in City parks needs to be updated to <br /> reflect the actual practice of allowing groups renting park facilities to hang banners that include <br /> sponsors; and <br /> WHEREAS, the procedure to retest water meters at a consumer's request needs to be <br /> updated to reflect current practices; and <br /> WHEREAS, to maintain the City's Federal Emergency Management Agency (FEMA) <br /> Community Rating System (CRS) program rating and resulting flood insurance discount for <br /> owners, floor elevation construction requirement updates are needed: and <br /> WHEREAS. clarification of the definition of accessory structures is needed to reflect intent <br /> and practice to limit structures to stated height limits or square footage limits: and <br /> WHEREAS. new state laws that preempt particular planning and zoning provisions require <br /> amendments as follows: SB 234 of 2019 deletes Chapter 18.124 Conditional Use Permits for <br /> Large Family Day Care Homes because state law requires them to be treated as permitted uses. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. Finds that the proposed amendments to the Pleasanton Municipal Code <br /> have no possibility to have a significant effect on the environment per Title 14 California Code of <br /> Regulations §15061(b)(3). <br />
