For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent easement and right of way for sidewalk and landscaping purposes,including the right to construct,replace, Inspect, maintain, repair, operate or remove sidewalks, pathways, landscaping including any and all appurtenances thereto,over.,under, upon and across the following described real property situated in the City of Pleasanton,County of Alameda,State of California,described as follows. Exhibits`A"and"B"attached hereto and made a part hereof: The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the easement However, such use by the Grand shall not include the construction of permanent structures, including but not limited to buildings, retaining.wails,decks, patios, or other concrete structures within the r easement e Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the surface of the ground to the condition in which it was prior to the oommencoment of said construction. Grantee agrees to maintain all improvements it constructs pursuant to the easement Grantor shall not be responsible fqr maintaining such improvements. This instrument shall run with the land and inure to the benefit of the successors and assigns of the pedes hereto.
