Heritage Inn of Pleasanton, LLC,a Nevada limited liability company and S.S. Heritage Inn of Pleasanton, LLC,a Nevada limited liability company,each as to an undivided fifty percent(5496)interest, as tenants in common(`Grantor")and the.City of Pleasanton(`Grantee"). For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent easement and right ofwa[y for roadway,sidewalk and landscaping purposes% including the right to construct, replace. inspect, maintain, repair, operate or remove a roadway, supporting columns,walls and footings, sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon and across the following described real properly situated in the City of Pleasanton, County of Alameda, ,State of California,described as follows: t Exhibits"A"and"B"attached hereto and made a part hereof. The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the easement. However, such use by the Grantor shall not include the construction of permanent sutures, including but not limited to buildings, retaining walls;decks, patios, or other concrete structuress within'the aasem ent.
