Heritage Inn of Pleasanton, LLC,a Nevada limited liability company and S.S. Heritage Inn of <br /> Pleasanton, LLC, a Nevada limited liability company, each as to an undivided fifty percent(50%)interest, <br /> as tenants in common("Grantor")and the City of Pleasanton("Grantee"). <br /> For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent <br /> easement and right of way for roadway,sidewalk and landscaping purposes,including the right to construct, <br /> replace, inspect, maintain, repair, operate or remove a roadway, supporting columns,walls and footings, <br /> sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon and <br /> across the fiollowing described real property situated in the City of Pleasanton, County of Alameda, State <br /> of California,described as follows.- <br /> Exhibits <br /> ollows:Exhibits"A"and"B"attached hereto and made a part hereof. <br /> The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the <br /> easement. However, such use by the Grantor shall not include the construction of permanent structures, <br /> including but not limited to buildings, retaining walls,decks, patios, or other concrete structures within the <br /> easement <br /> Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the <br /> surface of the ground to the condition in which it was prior to the commencement of said construction. <br /> This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties <br /> hereto. <br />
