ATTACHMENT #1 SEVENTH SUPPLEMENTAL AGREEMENT TO AGREEMENT FOR WASTEWATER DISPOSAL SERVICES This Seventh Supplemental Agreement (the "Seventh Supplemental Agreement") made and entered into this day of , 2022, by and between the CITY OF PLEASANTON, a municipal corporation (City) and the DUBLIN SAN RAMON SERVICES DISTRICT, a public agency of the State of California (District or DSRSD); collectively the "Parties"; WITNESSETH; WHEREAS, the Parties entered into that certain Agreement titled Agreement for Wastewater Disposal Services dated November 3, 1992, (herein defined as the "Basic Agreement"), by which the Parties' obligations for wastewater treatment and disposal are provided; and WHEREAS, supplemental agreements may be made to the Basic Agreement pursuant to Paragraph 17 thereof; and WHEREAS, subsequently the Parties entered into the First Supplemental Agreement in September 1997, the Second Supplemental Agreement in December 2000, the Third Supplemental Agreement in November 2002, the Fourth Supplemental Agreement in November 2009,the Fifth Supplemental Agreement in January 2014,and the Sixth Supplemental Agreement in June 2015; and WHEREAS, in the various supplemental agreements, the Parties agreed to certain terms and conditions related to the integration of supply, operations, and facilities of their respective Recycled water Programs (as defined in the Fifth Supplemental Agreement) and the Clean Water Revival Project; and WHEREAS, the District's West Dublin Trunk Sewer Line, traverses north to south in the City of Pleasanton from Highway 680 to the Regional Wastewater Treatment Facility in the vicinity of Johnson Drive as shown in Exhibit A; and WHEREAS, the West Dublin Trunk Sewer Line provides sewer collection system capacity for the District's Local Sewer Collection System customers and is funded by DSRSD Local Service Charges and Capacity Fees; and WHEREAS, at present, neither the City of Pleasanton or its customers pay DSRSD's Local Service Charges; and WHEREAS, wastewater from the properties along the western and northern sections of Johnson Drive and in the Commerce Circle area discharge into the City of Pleasanton wastewater collection system, which then discharge into the DSRSD West Dublin Trunk Sewer Line shown in Exhibit A; and WHEREAS,the West Dublin Trunk Sewer Line effectively provides capacity for the mutual benefit of the Parties but is not funded by revenues from the Regional Service Charge; and WHEREAS, the aforementioned properties do not pay the District's Local Collection System service charges which are intended to cover the cost of operation and maintenance of the West Dublin Trunk Sewer Line; and 1
