ATTACHMENT #1 <br /> SEVENTH SUPPLEMENTAL AGREEMENT <br /> TO <br /> AGREEMENT FOR WASTEWATER DISPOSAL SERVICES <br /> This Seventh Supplemental Agreement (the "Seventh Supplemental Agreement") made <br /> and entered into this day of , 2022, by and between the CITY OF PLEASANTON, <br /> a municipal corporation (City) and the DUBLIN SAN RAMON SERVICES DISTRICT, a public agency <br /> of the State of California (District or DSRSD); collectively the "Parties"; <br /> WITNESSETH; <br /> WHEREAS, the Parties entered into that certain Agreement titled Agreement for <br /> Wastewater Disposal Services dated November 3, 1992, (herein defined as the "Basic <br /> Agreement"), by which the Parties' obligations for wastewater treatment and disposal are <br /> provided; and <br /> WHEREAS, supplemental agreements may be made to the Basic Agreement pursuant to <br /> Paragraph 17 thereof; and <br /> WHEREAS, subsequently the Parties entered into the First Supplemental Agreement in <br /> September 1997, the Second Supplemental Agreement in December 2000, the Third <br /> Supplemental Agreement in November 2002, the Fourth Supplemental Agreement in November <br /> 2009,the Fifth Supplemental Agreement in January 2014,and the Sixth Supplemental Agreement <br /> in June 2015; and <br /> WHEREAS, in the various supplemental agreements, the Parties agreed to certain terms <br /> and conditions related to the integration of supply, operations, and facilities of their respective <br /> Recycled water Programs (as defined in the Fifth Supplemental Agreement) and the Clean Water <br /> Revival Project; and <br /> WHEREAS, the District's West Dublin Trunk Sewer Line, traverses north to south in the <br /> City of Pleasanton from Highway 680 to the Regional Wastewater Treatment Facility in the <br /> vicinity of Johnson Drive as shown in Exhibit A; and <br /> WHEREAS, the West Dublin Trunk Sewer Line provides sewer collection system capacity <br /> for the District's Local Sewer Collection System customers and is funded by DSRSD Local Service <br /> Charges and Capacity Fees; and <br /> WHEREAS, at present, neither the City of Pleasanton or its customers pay DSRSD's Local <br /> Service Charges; and <br /> WHEREAS, wastewater from the properties along the western and northern sections of <br /> Johnson Drive and in the Commerce Circle area discharge into the City of Pleasanton wastewater <br /> collection system, which then discharge into the DSRSD West Dublin Trunk Sewer Line shown in <br /> Exhibit A; and <br /> WHEREAS,the West Dublin Trunk Sewer Line effectively provides capacity for the mutual <br /> benefit of the Parties but is not funded by revenues from the Regional Service Charge; and <br /> WHEREAS, the aforementioned properties do not pay the District's Local Collection <br /> System service charges which are intended to cover the cost of operation and maintenance of <br /> the West Dublin Trunk Sewer Line; and <br /> 1 <br />
