IN THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA, STATE OF CALIFORNIA <br /> <br /> ORDINANCE NOo 439 <br /> <br /> AN ORDINANCE RELATING TO THE DEDICATION OF PUBLIC PARK <br /> LAND, THE PAYMENT OF FEES, OR A COMBINATION THEREOF, <br /> AS A CONDITION TO APPROVAL OF A FINAL SUBDIVISION MAP <br /> <br />SECTION 1. Definitions <br /> <br /> a. Subdivision - A subdivision, as used in this Ordinance <br />is the division of any land for any purpose whatsoever within the <br />City of Pleasanton and such land as may be annexed to said City. <br />It includes re-subdivision, the process of subdividing, or the <br />land or territory subdivided, including planned unit developments <br /> <br />SECTION 2. Conformance with General Plan <br /> <br /> The neigh'borhood park and recreational facilities for which <br />dedication of land andTor the payment of a fee is required by <br />this Ordinance are in accordance with the recreational element <br />of the General Plan of the City of Pleasanton, adopted on the <br />first day of March, 1965. <br /> <br />SECTION 3. Procedure <br /> <br /> As a part of the procedure for approval of a Tentative Sub- <br />division Map or in consideration of a minor subdivision applica- <br />tion, the Planning Commission shall determine the area and loca- <br />tion of land to be dedicated, or the amount of the fees required, <br />or a combination of both, as required by this Ordinance. The <br />dedication of land, or the payment of fees, or a combination of <br />both, shall be fixed and incorporated in a resolution of approval <br />of said Tentative Subdivision Map or application for a minor <br />subdivis ion. <br /> <br /> Land dedicated pursuant to this Ordinance shall be by nota- <br />tion, on the Final Subdivision Map or minor subdivision applica- <br />tion, or by separate instrument delivered to the City prior to <br />recording of the Final Subdivision Map or instruments creating <br />a minor subdivis ion. <br /> <br /> Where fees are payable, such shall be paid upon approval of <br />the Final Subdivision Map or application for minor subdivision, <br />or at such other time as may be fixed by the City Council, but <br />in no event later than the date of acceptance of public improve- <br />ments within said subdivision by the City. <br /> <br />SECTION 4. Parks: Principles and Standards <br /> <br /> As a condition of approval of a final subdivision map, the <br />subdivider shall dedicate land, pay a fee in lieu thereof, or <br />both, at the option of the City, for neighborhood park or rec- <br />reational purposes according to the following standards: <br /> <br /> ao A ratio of one (1) acre of land shall be dedicated to <br />the City for each one hundred (100) lots in the subdivision. In <br />the event that a Planned Unit Development Permit or zoning, <br />applicable on the date of the approval of the final subdivision <br /> <br /> - 1 - <br /> <br /> <br />
