property, but the lease agreement would allow for the proposed lighting to be installed <br /> further west on the UPPR property. This would reduce the impact of the lighting on the <br /> adjacent neighbors who have expressed concerns about the proposed lighting and <br /> provide better lighting for the parking area. However, if installed on UPPR property, the <br /> lights would need to be removed completely or relocated to the City's property if the <br /> lease is terminated. <br /> While funding is not budgeted at this time, the lease agreement allows for the parking <br /> lot to be improved to include curb and gutter, sidewalks, pavement, and landscaping to <br /> create a more inviting downtown parking lot. All improvements on UPRR's property <br /> would need to be removed at the termination of the lease. <br /> The lease will automatically renew each year with no end date established. UPRR can <br /> terminate the lease for the City's failure to make the annual lease payment. UPRR and <br /> the City can each terminate the lease without cause, provided noticing provisions are <br /> followed. However, if the City has constructed improvements on the UPRR property, <br /> those must be removed prior to the City's election to terminate the lease in order for <br /> UPRR to recognize the termination. <br /> Staff recommends that City Council approve the lease and authorize the City Manager <br /> to execute the lease. If City Council approves the lease, staff intends to alter the design <br /> of the parking lot lighting project to install the light standards on the UPRR property. <br /> After the lighting project design is complete and bid, it will be presented to City Council <br /> with a recommendation for the award of the construction contract. This is anticipated to <br /> occur in late fall 2022. Staff is not recommending any other improvements to the parking <br /> lot at this time.
