CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-067 <br /> <br />RESOLUTION MODIFYING THE APPROVED CONDITIONAL USE PERMIT <br />FOR BERNAL CORNERS, AS FILED UNDER CASE PCUP-61 <br /> <br />WHEREAS, <br /> <br />the Planning Commission requested a review of the approved conditional use <br />permit for Bernal Corners (southeast corner of Bernal Avenue and Valley <br />Avenue), a self-service gasoline station located at 1875 Valley Avenue with a <br />convenience market, quick-service restaurant, and carwash to consider hours of <br />operation, operation of the drive-through carwash, noise, perimeter fencing, and <br />other issues; and <br /> <br />WHEREAS, <br /> <br />at its meeting of July 28, 2004, the Planning Commission, after having considered <br />all public testimony, relevant exhibits, and recommendations of City staff <br />concerning this project, added conditions to the conditional use permit; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the owners of Bernal <br /> Corners submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, <br /> <br />at its meeting of September 7, 2004, the City Council received a report from the <br />Director of Planning and Community Development, together with a copy of the <br />staff report to the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on September 7, 2004, at which time the <br />owner of Bernal Corners and any other member of the public were offered an <br />opportunity to present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after a review of the materials presented, the City Council made a determination to <br />modify the approved conditional use permit by deleting certain conditions <br />approved by the Planning Commission and adding new conditions to the project; <br />and <br /> <br />WHEREAS, <br /> <br />after further review of the materials presented, the City Council determined that <br />the project is appropriate for the site and is consistent with the zoning regulations <br />for the zoning district of the property. <br /> <br /> <br />
