CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 04-067 RESOLUTION MODIFYING THE APPROVED CONDITIONAL USE PERMIT FOR BERNAL CORNERS, AS FILED UNDER CASE PCUP-61 WHEREAS, the Planning Commission requested a review of the approved conditional use permit for Bernal Corners (southeast corner of Bernal Avenue and Valley Avenue), a self-service gasoline station located at 1875 Valley Avenue with a convenience market, quick-service restaurant, and carwash to consider hours of operation, operation of the drive-through carwash, noise, perimeter fencing, and other issues; and WHEREAS, at its meeting of July 28, 2004, the Planning Commission, after having considered all public testimony, relevant exhibits, and recommendations of City staff concerning this project, added conditions to the conditional use permit; and WHEREAS, within the time specified by the Pleasanton Municipal Code, the owners of Bernal Corners submitted an appeal to the decision of the Planning Commission; and WHEREAS, at its meeting of September 7, 2004, the City Council received a report from the Director of Planning and Community Development, together with a copy of the staff report to the Planning Commission, regarding this matter; and WHEREAS, the City Council held a public hearing on September 7, 2004, at which time the owner of Bernal Corners and any other member of the public were offered an opportunity to present evidence regarding this appeal; and WHEREAS, after a review of the materials presented, the City Council made a determination to modify the approved conditional use permit by deleting certain conditions approved by the Planning Commission and adding new conditions to the project; and WHEREAS, after further review of the materials presented, the City Council determined that the project is appropriate for the site and is consistent with the zoning regulations for the zoning district of the property.
