The City Managers may grant a full-time regular employee leave of absence without pay for a period not <br /> to exceed three(3)months.After three(3)months,the leave of absence may be extended if so authorized <br /> by the Department. No such leave shall be granted except in writing stating the reasons for the requested <br /> leave. Upon expiration of the leave the employee shall be reinstated in the position held at the time the <br /> leave was granted. Failure on the part of an employee on leave to report to work promptly at its expiration <br /> or within a reasonable time after notice to return to duty,shall be cause for discipline. The Fire Chief may <br /> grant a full-time regular employee a leave of absence without pay for one(1)calendar week. During <br /> unpaid leave, an employee shall not accrue vacation or sick leave benefits, nor shall said time be <br /> considered service time. Holiday in lieu payments for which an employee would otherwise be eligible <br /> shall be adjusted on a pro-rata basis to reflect an employee's leave time. <br /> 15.2 Jury Service Leave <br /> Employees who are summoned for jury service in state or federal court shall receive their regular pay for <br /> all time they are necessarily absent from work in order to satisfy their jury service.The City may require <br /> proof of the time spent in such jury service as a condition of receiving the time off with pay and any <br /> monies received by the employee for their jury service shall be remitted to the City.Employees who are <br /> released from jury service and are not required to return for additional jury service the following day shall <br /> report directly to work to complete the remainder of their shift or workday.Employees who are required <br /> to serve as jurors shall not have their regular starting and ending work times changed as a result of jury <br /> service. <br /> 15.3 Leaves Resulting from Subpoena <br /> A. Employees subpoenaed or called to appear as a witness in an administrative or legal proceeding <br /> about a work-related matter shall be granted time off with pay for all time necessarily spent in <br /> compliance of the subpoena or request to testify,including travel time,waiting time and time spent <br /> testifying as a witness. <br /> B. Employees subpoenaed or called to appear as a witness on behalf of the City or Department during <br /> their off duty hours shall receive compensation as hours worked in accordance with Section 7 of <br /> this MOU for all time necessarily spent in compliance of the subpoena or request to testify, <br /> including travel time,waiting time and time spent testifying as a witness. <br /> 15.4 Military Leave <br /> Military leave shall be granted in accordance with the provisions of law. All employees entitled to military <br /> leave shall give the Fire Chief an opportunity within the limits of military regulations to determine when <br /> such leave shall be taken and may modify the employee's work schedule to accommodate the request for <br /> leave. <br /> 15.5 Family,Medical and Pregnancy Disability Leave <br /> The City will abide by all federal and state family,medical and pregnancy disability leave laws. <br /> 15.6 Catastrophic Leave <br /> 21 <br />
