SCOPE OF AGREEMENT 697 <br />4.1 Scope of Agreement 698 <br />Subject to Section 4.2, the Agreement granted to Contractor shall be exclusive for Collection, 699 <br />Transportation, Processing, and/or Disposal of Solid Waste, Recyclable Materials, Organic Materials, and 700 <br />Construction and Demolition Debris generated in the City, except where otherwise precluded by federal, 701 <br />State and local laws and regulations or where other current programs provide for Collection of Household 702 <br />Hazardous Waste. 703 <br />The Contractor shall be responsible for the following, as responsibilities may be limited by Section 4.2 or 704 <br />precluded by Applicable Law: 705 <br />A. Collecting all Solid Waste, Recyclable Materials, Organic Materials, and Construction and Demolition 706 <br />Debris generated in the City and placed by Single-Family, Multi-Family, and Commercial Generators 707 <br />in Containers. 708 <br />B. Collecting Solid Waste, Recyclable Materials, and Organic Materials from City facilities (as identified 709 <br />in Exhibit A of this Agreement) and at special events and Collecting Solid Waste and Recyclable 710 <br />Materials from public litter and recycling Containers (as identified in Exhibit A of this Agreement). 711 <br />C. Transporting Collected materials to the Approved Transfer Site, Approved Disposal Site, Approved 712 <br />Organic Materials Processing Site, or Approved Recyclable Materials Processing Site. 713 <br />D. Processing and marketing, or arranging for Processing and marketing of Recyclable Materials, 714 <br />Organic Materials, and Construction and Demolition Debris Collected in the City by Contractor. 715 <br />E. Providing public education to residents and businesses located in the City as defined in Exhibit B. 716 <br />F. Providing Customer service and billing service as necessary to fulfill its obligations under this 717 <br />Agreement. 718 <br />G. Implementing all services in accordance with this Agreement and as approved by the City. 719 <br />H. Furnishing all labor, supervision, vehicles, Containers, other equipment, materials, supplies, and all 720 <br />other items and services necessary to perform its obligations under this Agreement. 721 <br />I. Paying all expenses related to provision of services required by this Agreement including, but not 722 <br />limited to, taxes, regulatory fees, City fees, utilities, etc. 723 <br />J. Performing or providing all other services necessary to fulfill its obligations under this Agreement. 724 <br />K. Providing all services required by this Agreement in a thorough and professional manner so that 725 <br />residents, businesses, and the City are provided timely, reliable, courteous, and high-quality service 726 <br />at all times. 727 <br />L. Performing all services in substantial accordance with the Contractor’s Proposal and in full 728 <br />accordance with this Agreement at all times using best industry practice for comparable operations. 729
