For example if Contractor achieves 72.0% Diversion of C&D from temporary Debris Box service (other than Portland cement concrete and asphalt concrete, and taking into account only C&D projects where Contractor Collects all materials) in accordance with Section 5.22, it will pay $30,000. If the Contractor achieves 73.9% under the same circumstances, it will pay $20,000: 22 Each individual occurrence of delivering for Disposal Recyclable Materials, Organic Materials, or Salvageable Materials set out for Collection by the Customer (including use as ADC or AIC) rather than Processing, unless authorized per this Agreement: $500/Ton 23 Failure of Contractor to procure and provide the amount of Compost Product specified in Section 5.13.3 of this Agreement; directly to the City and/or through the required Compost giveaways: $250/Cubic Yard Customer Responsiveness 24 For each occurrence of unreasonably discourteous behavior by Contractor staff: $500.00 25 For each failure to respond to and initiate a remedy to a Complaint within eight (8) working hours after notification by the City: $300.00 26 For each failure to answer the telephone or answering machine during the hours specified in Section 6.8: $300.00 27 For each failure to respond to service requests/ calls within twenty-four (24) hours as specified in Section 6.8: $300.00 28 For each failure to return calls received during non- business hours no later than 5:00 p.m. of the following Business Day: $300.00 29 For each occurrence over five (5) annually for Complaints regarding waiting on hold for more than two (2) minutes as specified in Section 6.8.4: $150.00 Reporting and Performance Adjustments* 30 For each day that a Monthly Report is late: $100.00/ day 31 For each day that a Quarterly Report is late: $200.00/ day 32 For each day an Annual Report is late: $300.00/ day 33 For each failure to submit any individual report or provide access to records in compliance with and in the timeframe specified in this Agreement.
