City of Pleasanton Recitals <br /> Franchise Agreement with Pleasanton Garbage Service <br /> <br />City of Pleasanton Page 1 June 7, 2022 <br />Amended Agreement between 1 <br />the City of Pleasanton 2 <br />and 3 <br />Pleasanton Garbage Service, Inc. 4 <br /> 5 <br />For Solid Waste, Recyclable Materials and 6 <br />Organic Materials Collection Services 7 <br /> 8 <br />THIS AMENDED AGREEMENT is made and entered into as of the ___ day of __________, 2022, by and 9 <br />between the City of Pleasanton (hereinafter "the City") and Pleasanton Garbage Service, Inc. (hereinafter 10 <br />referred to as the "Contractor" or “PGS”). 11 <br />RECITALS 12 <br />This Agreement is entered into with reference to the following facts and circumstances: 13 <br />WHEREAS; the Legislature of the State of California, by enactment of the California Integrated Waste 14 <br />Management Act of 1989 (AB 939) (California Public Resources Code Section 40000 et seq.), has declared 15 <br />that it is in the public interest to authorize and require local agencies to make adequate provisions for 16 <br />Solid Waste Collection within their jurisdiction; 17 <br />WHEREAS; the State of California has found and declared that the amount of Solid Waste generated in 18 <br />California, coupled with diminishing Disposal Site space and potential adverse environmental impacts 19 <br />from landfilling and the need to conserve natural resources, have created an urgent need for State and 20 <br />local agencies to enact and implement an aggressive integrated waste management program. The State 21 <br />has, through enactment of AB 939 and subsequent related legislation including, but not limited to: the 22 <br />Jobs and Recycling Act of 2011 (AB 341), the Event and Venue Recycling Act of 2004 (AB 2176), SB 1016 23 <br />(Chapter 343, Statutes of 2008), the Mandatory Commercial Organics Recycling Act of 2014 (AB 1826), 24 <br />and the Short-Lived Climate Pollutants Bill of 2016 (SB 1383), directed the responsible State agency, and 25 <br />all local agencies, to promote Diversion and to maximize the use of feasible waste reduction, reuse, 26 <br />Recycling and Composting options in order to reduce the amount of refuse that must be Disposed; 27 <br />WHEREAS; SB 1383 establishes regulatory requirements for jurisdictions, Generators, haulers, Solid Waste 28 <br />facilities, and other entities to support achievement of State-wide Organic Waste Disposal reduction 29 <br />targets; 30 <br />WHEREAS; SB 1383 requires the City to implement Collection programs, meet Processing Facility 31 <br />requirements, conduct contamination monitoring, provide education, maintain records, submit reports, 32 <br />monitor compliance, conduct enforcement, and fulfill other requirements; and, the City has chosen to 33 <br />delegate some of its responsibilities to the Contractor, acting as the City’s designee, through this 34 <br />Agreement; 35
