ATTACHMENT 2 <br />RESOLUTION NO. 22- <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br />TO ADOPT RATES FOR SOLID WASTE, RECYCLABLE MATERIALS, AND <br />ORGANIC MATERIALS COLLECTION SERVICES <br />WHEREAS, on March 20, 2018 the City Council voted to approve and entered <br />into a franchise agreement between the City of Pleasanton and Pleasanton Garbage <br />Service Inc. for Solid Waste, Recyclable Materials, and Organic Materials collection <br />services; and <br />WHEREAS, on June 7, 2022 the City Council voted to approve an amended <br />franchise agreement between the City of Pleasanton Garbage Service Inc. to comply <br />with California state law SB 1383 requirements; and <br />WHEREAS, in accordance with Section 9.20.090 of the City of Pleasanton <br />Municipal Code, rates for franchise services shall be set by a resolution approved by the <br />City Council of the City of Pleasanton; and <br />WHEREAS, Pleasanton Garbage Service, Inc. shall conduct all billing related to <br />collection, transportation, recycling and disposal of said Solid Waste, Recyclable <br />Materials, and Organic Materials in strict accordance with rates listed in this <br />Resolutions; and <br />WHEREAS, the Franchise Agreement Section 8.3 requires an Index -based Rate <br />Adjustment for Rate Period Five and an application by Pleasanton Garbage Service <br />was submitted and approved as compliant with the methodology required under the <br />Franchise Agreement resulting in a 5.6 percent increase; and <br />WHEREAS, additional SB 1383 related costs were agreed upon in the amended <br />franchise agreement in the amount of $37,178 resulting in a 0.20 percent increase to <br />Index -based Rate Adjustment; and <br />WHEREAS, in accordance with the Index -Based Rate Adjustment methodology <br />and contractually agreed upon SB 1383 related costs the rate increase for rate period <br />five is 5.8 percent. <br />NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br />THE FOLLOWING: <br />SECTION 1: The fee schedule set forth in Resolution 21-1219 is hereby <br />rescinded. <br />SECTION 2: The rates for the collection, transport, and disposal of Solid Waste, <br />Recyclable Materials, and Organic Materials from the City of Pleasanton for <br />
