The franchise agreement stipulates that the <br />City Council may set a rate for an additional residential greenwaste or recycling cart. In <br />the first year of implementation of the contract, the 13.3 percent reduction in annual <br />operating costs negotiated into the franchise agreement was applied through various <br />residential and commercial rate categories. In creating the initial rate structure, the City <br />Council determined not to set a rate for an additional cart. The census data and <br />associated costs provided by PGS in order to set rate period one rates included the <br />costs of the additional residential carts for greenwaste and recycling, and PGS is being <br />compensated through the existing rates for these costs. Additionally, City staff <br />expressed concern that setting a rate for an additional greenwaste and recycling cart <br />could disincentive residents' participation in recycling and potentially impact compliance' <br />with SB 1383 and proper sorting requirements. <br />Lock charge and lock service for bins/enclosures. The agreement stipulates that PGS <br />must provide the services outlined below to Multi -Family and Commercial accounts. <br />"Contractor shall open and close gates, push and/or pull containers, lock and <br />unlock containers, or perform other services necessary to access and empty the <br />containers and shall not charge customers an additional fee for such services." <br />This is stipulated in the agreement (Section 5.2.3 and Section 5.2.5) and was known to <br />PGS at the time it prepared its census data and associated costs for the preparation of <br />Page 3 of 7 <br />
