would formalize the existing practice of allowing persons with rental or use agreements <br />to hang signs. For example, allowing a team to hang banners with league name and <br />sponsor logos on field fences during tournaments. <br />In Chapter 14.04 Regulation of Water System and Water Service Fees, §14.04.140 is <br />amended to reflect the actual City practice to have a third party company test water <br />meters that customers believe are not accurate, including use of industry standards. <br />Clarification about account credits or charges for inaccurate meters. <br />The following are proposed amendments to Titles 17 and 18 Planning and Zoning <br />Code: <br />In Chapter 17.08 Flood Damage Protection, §§17.08.150 and 17.08.180 need to be <br />updated to meet current requirements of the Federal Emergency Management Agency's <br />(FEMA) Community Rating System (CRS) program in order for property owners to <br />receive a 15 percent insurance discount. To maintain a CRS Class 7 rating, updated <br />building requirements are needed to raise floor elevations in Special Flood Hazard <br />Areas for regular construction and manufactured homes to federal standards. <br />In Chapter 18.08 Definitions, §§18.08.540 and 18.08.545 the definitions for Class I and <br />II Accessory Structures need to be clarified to reflect the intent and enforcement <br />practice that an accessory structure is restricted to height or square footage limitations. <br />Some have argued that the current language requires an accessory structure to exceed <br />both height and size limits to be in violation of the code. <br />Chapter 18.124, Article III. Conditional Use Permits for Large Family Day Care Homes <br />is proposed to be deleted in its entirety because state law (SB 234 of 2019) pre-empts <br />local regulations and requires large family day care homes to be treated as permitted <br />uses. <br />The Master Fee Schedule is also proposed to be amended to: <br />(1) Clarify that hourly rates for water service replacement and damage costs also apply <br />to removal and replacement of meters for retesting requested by the consumer, and <br />(2) Update water meter models. These current costs (last updated in 2011) now include <br />radio telemetry technology for electronic meter reading. This change is proposed to go <br />into effect July 1, 2022. <br />The resolution to amend the Master Fee Schedule is Attachment 2. <br />RECOMMENDATION <br />Introduce the omnibus ordinance and adopt the resolution amending the Master Fee <br />Schedule. <br />Page 3 of 4 <br />
