1 <br />THE CITY OF 141 <br />" CITY COUNCIL AGENDA REPORT <br />PLEASANTON. <br />June 21, 2022 <br />City Attorney <br />TITLE: INTRODUCE AN OMNIBUS ORDINANCE TO AMEND THE MUNICIPAL <br />CODE REGARDING ADMINISTRATIVE CITATION PROCEDURES, <br />ADMINISTRATION AND PERSONNEL, BUSINESS LICENSE APPEALS, <br />ANIMALS, PARKING, ACTIVITIES IN PARKS, METER TESTING, AND <br />TITLES 17 AND 18 PLANNING AND ZONING, AND WAIVE FIRST <br />READING; ADOPT A RESOLUTION AMENDING MASTER FEE <br />SCHEDULE REGARDING WATER METERS <br />SUMMARY <br />The omnibus ordinance is a regular process to update the municipal code to reflect new <br />state laws, and have the code reflect actual practice. These amendments are non- <br />controversial and presented as one ordinance. This year's omnibus changes include: <br />• §§1.24.030 and 1.24.090 to codify the existing practice of signing administrative <br />citations and appearing for appeals; <br />• §2.08.020 to delete residency requirement to comply with California constitution; <br />Y §5.08.070 to have business license appeals heard by administrative hearing officer; <br />• §7.24.010 to clarify actual practice of Police Department's Animal Control Officer <br />when animals are at large (un -leashed); <br />• §11.36.180 to restrict parking of non-commercial vehicles longer than 23 feet in <br />length to reflect bigger passenger vehicles; <br />§13.08.100 to reflect existing practice that organizations with rental or use <br />agreements may hang banners during events per City policy; <br />• §14.04.140 update how the City actually tests water meters that may be inaccurate; <br />• §§17.08.150 and 17.08.180 to make flood protection construction criteria align with <br />current FEMA flood insurance requirements; <br />• §§18.08.540 and 18.08.545 to clarify how accessory structures are measured; and <br />• Chapter 18.124's Article III. Conditional Use Permits for Large Family Day Care <br />Homes to be deleted because state law (SB 234 of 2019) requires them to be <br />treated as permitted uses. <br />The resolution is to amend the Master Fee Schedule to reflect water meter retesting <br />costs, current meter models, and remote reading technology. <br />RECOMMENDATION <br />Introduce the omnibus ordinance and waive first reading, and adopt resolution. <br />FISCAL IMPACT <br />Updating existing signs for amended maximum vehicle length is a de minimis cost that <br />can occur with stickers; there are no other fiscal impacts. Master Fee Schedule change <br />for water meters reflects actual costs. <br />
