ATTACHMENT#I Contract#2019069 SECOND AMENDMENT TO AGREEMENT This Second Amendment to Agreement("Second Amendment") is entered into this day of June 2022, by the City of Pleasanton ("City") and PSC Industrial Outsourcing,LP. (dba HydroChem PSC) ("Contractor") Whereas, on June 19, 2018, the City and Contractor entered into a Standard Services Agreement for Hazardous Waste Hauling and as-needed Emergency response basis for City identified locations ("Agreement"); and Whereas,on March 26, 2021,both parties mutually agreed by the First Amendment to extend the term and add additional work by increasing the not exceed amount to $235,000 through June 30, 2021, and set the compensation for FY 2021/22 at$80,000 (collectively the "Agreement'); and Whereas,the parties desire to amend the Agreement by extending the term for the fifth and final year and maintain the not to exceed amount of$95,000 for FY 2022/23 for the remaining term of the Agreement. Now, therefore, in exchange for valuable consideration,the receipt of which is hereby acknowledged, the parties agree as follows: 1. Section 1 of this Agreement"Term"is amended to read as follows: The Term of this Agreement will expire on June 30, 2023. 2. Section 3 of the Agreement, "Compensation" is amended to read: The Compensation for Work Authorization shall not exceed$95,000 for FY 2022/23. 3. All other terms and conditions of the Agreement shall remain in full force and effect.
