Article 5. Collection Services <br /> Section 5.9.1 Community Drop Off Events amended to comply with SB 1383 as follows: <br /> "Contractor shall ensure that all Yard Trimmings received during the community <br /> drop-off events are kept separate from other Discarded Materials and deliver the <br /> material to the Organic Materials Processing Site for Processing, in accordance <br /> with this Agreement and SB 1383." <br /> Section 5.13.3 B. Organic Materials Processing added information outlining SB 1383 <br /> compliance requirement as follows: <br /> "Contractor shall observe and comply with all regulations in effect at the <br /> Approved Organic Materials Processing Site and cooperate with and take <br /> direction from the operator thereof with respect to delivery of Organic Materials. <br /> Contractor shall actively work with the Approved Organic Materials Processing <br /> Site operator throughout the Term of this Agreement to ensure that <br /> contamination of the Organic Materials Collected under this Agreement and <br /> delivered to the Processing Site remains below the limits established by <br /> Applicable Law including, without limitation, SB 1383." <br /> Also added to this section is the process for use of compostable plastics in the organic <br /> stream. Compostable plastics such as bags and foodware are no longer allowed at <br /> many Processing Facilities, and, as such, are not currently accepted for collection in the <br /> city. The amendment instead outlines the process to be used if the City decides to allow <br /> use of Compostable Plastics in the future, in alignment with facility notification <br /> requirements under SB 1383 related to these materials. <br /> "If City requests that Compostable Plastics be included as an Organic Material <br /> Collected under this Agreement, Contractor shall make commercially reasonable <br /> efforts to locate an Approved Organic Materials Processing Facility that will <br /> accept Compostable Plastics, subject to City approval. Contractor shall notify the <br /> City in writing at least six (6) months prior to the commencement of the <br /> Agreement, and annually thereafter, of the acceptable materials requirements of <br /> the Approved Organic Materials Processing Facility and to what degree, if at all, <br /> it is able to accept Compostable Plastics. If Compostable Plastics are accepted <br /> in the City's Organic Materials Collection program in the future, Contractor shall <br /> update its education materials as needed to reflect such change, in accordance <br /> with Section 5.17." <br /> Another addition made to Section 5.13.3 B. Organic Materials Processing is to address <br /> concerns regarding capacity to process organics materials and new regulatory <br /> requirements at organic processing facilities. The Agreement stipulates that if PGS <br /> requests a change or addition to an Approved Processing Facility, that PGS would <br /> encumber all related costs of this change at no additional cost to the Rate Payer. There <br /> is a potential that the Commercial Organics will no longer be accepted at the current <br /> Approved Processing Facility and the cost estimates per ton are significantly higher <br /> Page 8 of 22 <br />
