APPENDIX B <br /> SAMPLE CONTRACT LANGUAGE <br /> B.I. Recovered Organic Waste Product Enforceable Mechanism Language <br /> The following language may be included in City contracts and agreements to ensure <br /> compliance with the City's Recovered Organic Waste Product procurement <br /> requirements described in Section 5.4 above. <br /> Section X, Adherence to City's Green Purchasing Guidelines and SB 1383 <br /> Procurement Requirements <br /> 1. Contractor shall ensure that all services provided to the City under this <br /> Agreement, and all products the Contractor uses to service the City under this <br /> Agreement, shall comply with all applicable requirements in Appendix A, <br /> Green Purchasing Guidelines and SB 1383 Procurement Requirements, unless <br /> otherwise approved by the City Representative. <br /> 2. Contractor will permit the City to audit, examine and make copies of all <br /> contracts, invoices, and other documents or data relating to this Agreement. <br /> Such records shall be maintained for (5) five years from the date of final <br /> payment under this Agreement. <br /> 3. City may assess liquidated damages and/or terminate this Agreement at any <br /> time if Contractor is found to be non-compliant with the applicable <br /> requirements in Appendix A. <br /> Purchasing Procedures and Manual 33 <br />
