August 31, 2022. Both the City and Zone 7 agreed that a proposed License Agreement <br />was necessary to update the underlying 50 year-old Agreement to reflect the changes it <br />the recreational use of the trails. Zone 7 is utilizing a standardized license agreement <br />template with the cities of Dublin, Livermore, and Pleasanton for public trails along Zone <br />7 maintenance roads, as the communities share similar interests and concerns. <br />These trails play a critical role in the city's trail system and provide both a recreational <br />benefit, and non -vehicular travel corridors, for the city and its residents. Approving the <br />proposed 25 -year Recreational Use License Agreement will provide the city and the <br />region with a valuable resource that not only provides access to recreation but provides <br />alternate safe transportation routes to navigate the city. The trails provide a connection <br />to other regional trails, such as the Iron Horse Trail. Exhibit A and Exhibits B1 through <br />B5 of Attachment 1 show all the areas covered under the License Agreement as well as <br />the individual trail segments currently open for public recreation. <br />The proposed License Agreement also provides a framework for maintenance <br />responsibilities. City staff have closely reviewed the terms with Zone 7 staff to make <br />sure that the agreement addresses the City's interest that Zone 7 remain responsible for <br />the clean-up of any encampments in the Arroyo, while the City is responsible for City - <br />installed improvements. The proposed agreement includes a mechanism for making <br />improvements to any existing trail segments and the ability to easily add future trail <br />segments. All existing permanent facilities and landscape improvements on the <br />Licensed Areas will be approved by Zone 7 and do not require further approvals as of <br />the date of the proposed License Agreement. <br />The proposed License Agreement supersedes the original agreement and any <br />modifications made thereafter that included additional trails and term extensions and will <br />become effective when executed by both parties. <br />City staff recommends the City Council approve the proposed agreement and authorize <br />the City Manager to execute all documents necessary to enter into the agreement. <br />Submitted by: <br />"-V�� <br />Kathleen Yurchak <br />Director of Operations <br />and Water Utilities <br />Fiscal Review: <br />in Shah <br />Interim Director of Finance <br />Approved by: <br />f_'11)114_ <br />Brian Dolan <br />Interim City Manager <br />Attachment: <br />1.
