Wel <br />THE CITY OF 111 <br />., . ­ CITY COUNCIL AGENDA REPORT <br />PLEASANTON. <br />May 17, 2022 <br />Operations Services <br />TITLE: APPROVE A NEW 25 -YEAR RECREATIONAL USE LICENSE <br />AGREEMENT WITH ZONE 7 WATER AGENCY FOR THE <br />RECREATIONAL USE OF MAINTENANCE ROADS FOR PUBLIC <br />TRAILS ALONG FLOOD CONTROL CHANNELS <br />SUMMARY <br />The City of Pleasanton has made trails available for the public along the Zone 7 Water <br />Agency's (Zone 7) maintenance roads at the flood control channels since 1971 under a <br />Recreational Use License Agreement. There have been five separate modifications to <br />that agreement. Modification No. 5 approved by City Council on September 21, 2021, <br />extended the original term until August 31, 2022, to allow staff time to negotiate a new <br />agreement that updates the underlying agreement and reflects the changes in <br />recreational use of the trails. <br />The proposed License Agreement provides a framework for maintenance <br />responsibilities. Zone 7 will remain responsible for the clean-up of any encampments in <br />the Arroyo, while the City is responsible for City -installed improvements. This <br />agreement also includes a mechanism for making improvements to any existing trail <br />segments and the ability to easily add future trail segments. All existing permanent <br />facilities and landscape improvements on the Licensed Areas will be approved by Zone <br />7 and do not require further approvals as of the date of the proposed License <br />Agreement. <br />Staff negotiated the proposed 25 -year Recreational Use License Agreement with Zone <br />7. The proposed License Agreement supersedes and replaces the original 1971 <br />Agreement and any modifications made thereafter and will go into effect when the <br />proposed agreement is approved. <br />RECOMMENDATION <br />Staff recommends the City Council approve the proposed 25 -year Recreational Use <br />License Agreement with Zone 7 and authorize the City Manager to sign all necessary <br />documents. <br />FINANCIAL STATEMENT <br />There is no additional fiscal impact to approving the proposed Recreational Use License <br />Agreement. The City's maintenance costs under this Agreement are already included in <br />the Operations Services Department Trails and Medians operations budget at an <br />approximate cost of $55,000 per year. <br />
