9 <br /> THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTON. <br /> May 17, 2022 <br /> Engineering <br /> TITLE: ADOPT RESOLUTIONS APPROVING THE ENGINEER'S REPORTS FOR <br /> LANDSCAPE MAINTENANCE DISTRICTS 1984-1 (PONDEROSA-DEL <br /> PRADO), 1993-1 (WINDSOR), 1993-2 (BONDE RANCH), 1994-1 (OAK <br /> TREE FARM), AND 1995-1 (MOLLER RANCH), DECLARING THE CITY'S <br /> INTENTION TO ASSESS THE PROPERTIES FOR THE COST TO <br /> OPERATE AND MAINTAIN THE DISTRICTS AND SETTING JUNE 21, <br /> 2022, AT 7 P.M., AS THE DATE AND TIME FOR THE PUBLIC HEARING <br /> SUMMARY <br /> The annual Engineer's Reports for the maintenance of the Landscape Maintenance <br /> Districts (LMDs) in the Ponderosa-Del Prado, Windsor, Bonde Ranch, Oak Tree Farm, <br /> and Moller Ranch subdivisions have been completed for FY 2022/23. The Engineer's <br /> Reports determine the assessment that will be levied against each property owner <br /> within each LMD for the electrical costs, maintenance, and irrigation for the special <br /> district landscaping installed as part of each development. It is recommended that City <br /> Council approve the Engineer's Report for each LMD, declare the intention to levy and <br /> collect assessments, schedule a public hearing for June 21, 2022, to receive testimony <br /> from those that will be subject to the assessments, and direct the City Clerk to advertise <br /> a Notice of Annual Hearing ten days prior to the hearing. All assessment amounts <br /> remain unchanged from previous years. However, this is unsustainable as costs have <br /> increased, which has resulted in the level of maintenance decreasing significantly since <br /> the districts were created. In addition, reserves for capital replacement are limited or <br /> non-existent. Staff hired a consultant that specializes in LMDs, SCI Consulting Group, to <br /> determine appropriate assessments for future years, perform public outreach to discuss <br /> the requirements and potential assessments, and hold a Proposition 218 compliant vote <br /> as is necessary for an increase in assessments. Voting for the Bonde Ranch LMD was <br /> scheduled for this year but put on hold due to opposition of the Bonde Ranch property <br /> owners. Voting for the Windsor LMD was also scheduled for this year but put on hold to <br /> gather further input from the property owners at their request. <br /> RECOMMENDATION <br /> 1. Approve the Engineer's Reports. <br /> 2. Adopt the resolutions that direct filing of the annual reports, declaring the intention to <br /> order improvements and the intention to levy and collect assessments. <br /> 3. Schedule a public hearing for June 21, 2022, and authorize the City Clerk to <br /> advertise a Notice of Annual Hearing (Cal. Streets & Highways Code §22626) ten <br /> days prior to the hearing. <br />
