RESOLUTION NO. 22-1287 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON DECLARING <br /> RESULTS OF MAJORITY PROTEST PROCEEDINGS AND RENEWING THE TRI-VALLEY <br /> TOURISM MARKETING DISTRICT <br /> WHEREAS, on December 5, 2005, the City Council of the City of Pleasanton adopted the <br /> Management District Plan (Plan) and established the Tri-Valley Tourism Business Improvement <br /> District; and <br /> WHEREAS, on June 19, 2015, the City Council modified the MDP and renewed the Tri- <br /> Valley Tourism Business Improvement District as the Tri-Valley Tourism Marketing District; and <br /> WHEREAS, the Property and Business Improvement District Law of 1994, Streets and <br /> Highways Code §36600 et seq., authorizes the City to renew business improvement districts upon <br /> petition by a weighted majority of the business owners located within the boundaries of the district; <br /> and <br /> WHEREAS, lodging business owners who will pay more than fifty percent (50%) of the <br /> proposed assessment, as weighted according to the amount of the assessment to be paid by the <br /> petitioner, within the boundaries of the MMD have petitioned the City Council to renew the <br /> TVTMD; and <br /> WHEREAS, the renewed TVTMD includes lodging businesses in the Town of Danville <br /> (Town), the cities of Dublin, Livermore, and Pleasanton (Cities) and those portions of the <br /> unincorporated areas of Contra Costa and Alameda Counties (Counties), which include the <br /> communities of Alamo, Blackhawk, and Sunol, the portion of the counties that lies between the <br /> cities of Pleasanton and Livermore, and that portion of Alameda County which lies southeast of <br /> Interstate 580; and <br /> WHEREAS, consent to include lodging businesses in their respective jurisdictions has <br /> been received from the Town, Cities, and Counties; and <br /> WHEREAS, included with the petitions was a Management District Plan summary that <br /> describes the proposed assessment to be levied on lodging businesses within the TVTMD to pay <br /> for sales & marketing and destination development programs, and other improvements and <br /> activities set forth in the Plan; and <br /> WHEREAS, the assessed lodging businesses within the TVTMD will receive a specific <br /> benefit from the activities and improvements set forth in the Plan; and <br /> WHEREAS, on January 18, 2022, the City Council adopted a Resolution of Intention to <br /> Renew the Tri-Valley Tourism Marketing District and Fixing the Time and Place of Public <br /> Hearings, Resolution No. 22-1267; and <br /> WHEREAS, the Resolution of Intention was published and mailed in accordance with <br /> Streets and Highways Code Section 36636; and <br /> WHEREAS, the City Council held a duly noticed public hearing at its regular meetings on <br /> March 15, 2022. and April 19, 2022.. regarding the renewal of the TVTMD, and the City Council <br />
