Resolution No. 04-053 <br />Page Two <br /> <br />WHEREAS, the City Council further finds that the proposed project will have no potential for <br /> adverse impacts on the site's wildlife. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Approves the Negative Declaration for the for the Martin Avenue buffer zone and <br />storm drainage projects generally described as (1)establishment of a license <br />agreement with Zone 7 of the Alameda County Flood Control and Water <br />Conservation District for public use of the open space "buffer zone" along the east <br />side of Martin Avenue; (2) the construction of a 54-inch storm drain line from <br />Mohr Avenue to the northerly terminus of Martin Avenue within the trail corridor; <br />(3) acquisition of a permanent trail easement from Zone 7 for the trail along the <br />east side of Martin Avenue and reconstruction of the trail; (4)associated tree <br />removal, tree trimming, stump removal, and new tree planting within the <br />construction zone; and (5) the widening of Martin Avenue northerly of Diablo <br />Court approximately four feet, to a 20-foot width, and installation of a water line <br />within this segment of Martin Avenue. <br /> <br />Section 2. <br /> <br />The City staff is directed to cause a Notice of Determination to be filed pursuant to <br />Section 5.4(g) of Resolution No. 77-66. <br /> <br />Section 5 This resolution shall become effective immediately upon its passage and adoption. <br /> <br /> I HEREBY CERTIFY THAT THE FOREGOING WAS DULY AND <br />REGULARLY ADOPTED BY THE CITY COUNCIL OF THE CITY OF PLEASANTON, AT <br />A MEETING HELD ON JULY 20, 2004 BY THE FOLLOWING VOTE: <br /> <br />AYES: <br />NOES: <br />ABSENT: <br />ABSTAIN: <br /> <br />Councilmembers - Ayala, Brozosky, Hosterman, and Mayor Pico <br />None <br />Councilmember Campbell <br />None <br /> <br /> ATTEST: <br /> <br />Dawn G.
