<br />PLANNING COMMISSION CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />RESOLUTION NO. PC-97-02 <br /> <br />RESOLUTION APPROVING THE RECONSIDERATION OF THE PREVIOUS <br />PLANNING COMMISSION ACTION DENYING A MAJOR MODIFICATION OF <br />THE PUD DEVELOPMENT PLAN FOR THE BONDE RANCH SUBDIVISION, AS <br />FILED UNDER PUD-90-18-2M <br /> <br />WHEREAS, at its meeting of September 11, 1996, the Planning Commission denied the <br />application of Joseph Zuffa for a major modification of the approved PUD <br />Development Plan for the Bonde Ranch subdivision to reduce the required 20' 0" <br />building to building separation and to allow an existing carport and retaining wall <br />in the side yard of a single-family residence located at 839 East Angela Street; and <br /> <br />WHEREAS, the applicant has requested reconsideration of the Planning Commission's action <br />requiring that the side yard slope bank be restored to its original configuration and <br />that the retaining wall be removed; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C-C (Central <br />Commercial) District; and <br /> <br />WHEREAS, at their duly noticed public hearing of January 8,1997, the Planning Commission <br />considered all public testimony, relevant exhibits, and recommendations of the <br />City staff concerning this application; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the retaining wall is consistent with the <br />overall design objectives of the Bonde subdivision, is hidden from public view by <br />private fencing, is properly engineered and constructed to retain the slope bank, <br />and is supported by the adjacent homeowner <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Upon reconsideration, approves the existing retaining wall and grading for the lot <br />located at 839 East Angela Street (Lot #22 within the Bonde Ranch <br />Development), subject to the conditions shown in Exhibit "B," attached hereto <br />and made part of this case by reference. <br /> <br />Section 2 <br /> <br />This resolution shall become effective 15 days after its passage and adoption <br />unless appealed prior to that time. <br />
