<br />Resolution No. PC-97-01 <br />Page 4 <br /> <br />EXHIBIT "B" <br />Conditions of Approval <br />Case UP-96-83 <br />Gina Samsel d.b.a. The Pleasanton Spa <br /> <br />I. The proposed use shall conform substantially to the written narrative, site plan, and floor <br />plan, Exhibit "A", dated "Received November 15, 1996", on file with the Planning <br />Department, except as modified by these conditions. <br /> <br />2. If operation of the proposed use results in conflicts pertaining to parking, noise, traffic, <br />or other impacts, at the discretion of the Planning Director, this use permit may be <br />submitted to the Planning Commission for subsequent review at a public hearing. If <br />necessary, the Commission may modify or add conditions of approval to mitigate such <br />impact, or may revoke the use permit. <br /> <br />3. If additional activities beyond that proposed in the written narrative, dated Received <br />November 15, 1996", on file with the Planning Department are desired, prior City review <br />and approval are required. Such modifications shall be submitted to the Planning <br />Director, who shall refer the matter to the Planning Commission if determined to be <br />substantial. <br /> <br />4. No more than one licensed massage therapist shall operate in the designated tenant suite <br />at one time. <br /> <br />5. The hours of operation for the subject business shall be limited to Tuesday through <br />Saturday, 10 a.m. to 7 p.m.. Minor changes to the hours of operation may be submitted <br />for review and approval by the Planning Director. <br /> <br />6. The applicant shall obtain all other applicable City permits prior the commencement of <br />the use. <br /> <br />7. This use permit is not transferable to another address. A new application must be made if <br />the applicant relocates to another site. <br /> <br />8. No signage for the business is approved as part of this application. Any signage shall <br />conform to the previously-approved sign program for the building and shall be subject to <br />the review and approval of the Planning Director prior to installation. <br /> <br />9. No massage therapist may operate until the required Police Department approvals and <br />registrations are obtained. Such registrations shall remain in effect as long as the <br />business is in operation. <br /> <br />{end} <br /> <br />I I <br />
