P21-0715, Housing Element 6th Cycle — Review and provide a recommendation on <br /> housing policy topics including the inclusionary zoning ordinance, lower-income housing <br /> fund, and related City programs as part of the 2023-2031 (6th Cycle) Housing Element <br /> Update <br /> Ms. Bonn presented the specifics on the item in the Agenda Report. <br /> Commissioner Brown requested clarification on staffs recommendation to flip the 15% <br /> inclusionary unit requirement for multifamily development compared to a 20% requirement for <br /> single-family units. Ms. Bonn explained that multifamily projects tended to more consistently <br /> construct the units, and single-family projects generally utilized the in-lieu fee. Commissioner <br /> Brown asked if changing the inclusionary unit requirement would result in a lower in-lieu fee paid <br /> because developers are usually paying it based on the 20 percent. Ms. Clark explained that the <br /> fee would be proportionality lower and the City Council would have to debate whether it was a <br /> reversal ("flip") or bringing rates to the same level. Commissioner Brown stated he was not in <br /> favor of an affordable housing overlay zone. He asked the timeline to create a Density Bonus <br /> Ordinance that aligned with State law and whether the recommendations would come back to <br /> the Planning Commission. Ms. Clark stated it depended on the directional scope and that if <br /> aligned with State laws it would be a mechanical process but more complicated for a locally <br /> constructed density bonus ordinance. <br /> Commissioner Morgan asked about lower income housing fees and nexus fees. Ms. Bonn <br /> provided the 2018 Nexus Study and Fee Increase and explained the fee increases and the <br /> maximum fees identified in the Nexus Study. Commissioner Morgan asked for clarification on <br /> the means of determining the 2022 fees. Ms. Clark explained the fees increased based on the <br /> Construction Cost Index, which was in line with surrounding jurisdictions. She explained that the <br /> City Council would have to approve an entirely new fee schedule. Commissioner Morgan asked <br /> how the 2019 fees were established. Ms. Clark stated the Nexus Study outlined the methodology <br /> for establishing the fees including construction costs and demands; she also described the <br /> Planning Commission Minutes Page 2 of 7 February 9, 2022 <br /> may further the fair and efficient running of the meeting, such as <br /> reducing the amount of testimony time allotted to the applicant and all those who wish to speak when the meeting agenda is <br /> lengthy or when there are numerous speakers for any specific item.The audience is requested to respect and extend courtesy <br /> to all those wishing to testify on all cases by being quiet while others are speaking. <br /> ************************************** <br />
