The Initial Study/Mitigated Negative Declaration prepared for the Project has been completed in compliance with CEQA; and 3. The Initial Study/Mitigated Negative Declaration represents the independent judgment and analysis of the City of Pleasanton as lead agency for the Project. The Planning Commission recommends the City Council find based upon the entire record of proceedings before it and all information received there is no substantial evidence the Project will have a significant effect on the environment and does hereby recommend the City Council adopt the Mitigated Negative Declaration prepared for the Project. The Initial Study/ Mitigated Negative Declaration are: (1) on file in the Planning Division located at 200 Old Bernal Avenue, Pleasanton, California 94566; and (2) available for inspection by any interested person/party. Section 2: This resolution shall become effective immediately upon its passage and adoption. PASSED, APPROVED AND ADOPTED by the Planning Commission of the City of Pleasanton at a regular meeting held on May 26, 2021, by the following vote: Ayes: Commissioners Allen, Brown, Gaidos, Nibert, Pace Noes: None Absent: None Abstain: None ATTEST: DocuSigned by: juu, G. 12rowt, 420F70711FFFA42R Melinda Denis Justin Brown Secretary, Planning Commission Chair APPROVED AS TO FORM: Larissa Seto Assistant City Attorney ; and WHEREAS, the Initial Study concluded that the implementation of the Project would not result in any significant impacts to the environment; and WHEREAS, on April 2, 2021 , Notice of Notice of Intent (NOI) to Adopt a Draft Initial Study (IS) and Proposed Mitigated Negative Declaration (MND) were sent to interested parties and property owners/residents in accordance with California Environmental Quality Act (CEQA) Guidelines Section 15072; and WHEREAS, at its duly noticed public meeting of May 26, 2021, the Planning Commission considered the written agenda report, all public testimony, relevant exhibits, and staff recommendations. NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Pleasanton, based on the entire record of proceedings, including the oral and written agenda reports and all public comment and testimony: Section 1: Recommends the City Council make the following findings for adoption of the Mitigated Negative Declaration: 1. It has independently reviewed and analyzed the Initial Study/Mitigated Negative Declaration and other information in the record and has considered the information contained therein, prior to acting upon or recommending approval of the Project; and nd all future owners of the property shall, at no expense to the City, maintain all the landscaped areas related to the project in a healthful, attractive and reasonably weed-free manner consistent with the approved landscape plan, for the duration of the existence of the project.
