NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE <br /> CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER <br /> THE FOLLOWING: <br /> SECTION 1. The City, or a contractor awarded the work by the City, is ordered <br /> to abate the nuisance declared by Resolution No. 22-1282 by causing the weeds, dirt, <br /> rubbish and refuse to be removed. The City, contractor, Livermore-Pleasanton Fire <br /> Department (LPFD) Fire Inspector, and Fire Inspector's designee may enter upon <br /> private property to abate the nuisance. Before the weeds are abated by the City or <br /> contractor, any property owner may remove the weeds, rubbish, or refuse at the <br /> property owner's own expense. <br /> SECTION 2. LPFD shall keep an account of the abatement cost for each parcel <br /> on which work is done and shall submit to the City Council for consideration, hearing <br /> objections, modification, and confirmation, an itemized written report showing the cost <br /> pursuant to Government Code Section 39574. <br /> SECTION 3. The weed abatement costs, including a 100% administrative <br /> charge, and if related litigation is required, all attorneys' fees, expenses, and costs, shall <br /> be the responsibility of the property owner of the parcel of land where the work was <br /> done. <br /> SECTION 4. This resolution shall become effective immediately upon its <br /> passage and adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of <br /> Pleasanton at a regular meeting held on April 19, 2022. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the <br /> foregoing resolution was adopted by the City Council at a regular meeting held on the <br /> 19th day of April 2022, by the following vote: <br /> Ayes: <br /> Noes: <br /> Absent: <br /> Abstain: <br /> Jocelyn Kwong, City Clerk <br /> APPROVED AS TO FORM: <br /> Daniel G.
