The cities of Dublin and Livermore, the Town of Danville, and the counties of Alameda <br /> and Contra Costa, will each be paid a fee equal to 1 percent of the amount of the <br /> assessments collected within their jurisdiction to cover their costs of collection and <br /> administration. The City of Pleasanton will be paid a fee equal to 1 percent of the <br /> amount of the assessment collected in the city, plus 1 percent of the total assessment <br /> collected from all jurisdictions to cover the costs of collection and administration. <br /> Per the Management District Plan, Visit Tri-Valley will place up to 5 percent of all Tri- <br /> Valley Tourism Marketing District assessments received into a Contingency Fund. <br /> Contingency funds collected may be held in a reserve fund or utilized for other program, <br /> administration, or renewal costs at the discretion of the VTV Board. <br /> DISCUSSION <br /> To begin the formal process of renewing the Tri-Valley Tourism Marketing District, on <br /> January 18, 2022, the City Council adopted both a Resolution of Intention to renew the <br /> business improvement district and a Resolution Requesting Consent from the Cities <br /> Dublin and Livermore, Town of Danville, and Contra Costa County. The Alameda <br /> County Board of Supervisors consented to future renewals by adopting Resolution No. <br /> 2015-64 on March 3, 2015, as part of the previous renewal process. In each of the cities <br /> and counties, the Resolution Granting Consent to the City of Pleasanton to be included <br /> in the TVTMD was approved; city staff has copies of the resolutions granting consent <br /> from each of the partner agencies. <br /> Public Hearings <br /> The City of Pleasanton held the first of two public hearings on March 15, 2022, to hear <br /> any protest to the renewal of the Tri-Valley Tourism Marketing District. A final public <br /> hearing will be held on April 19, 2022, to accept protest or other comments regarding the <br /> TVTMD renewal. If written protests are received from the owners of businesses in the <br /> renewed TVTMD which will pay more than fifty percent (50%) of the assessments <br /> proposed to be levied and protests are not withdrawn so as to reduce the protests to less <br /> than fifty percent (50%), no further proceedings to levy the proposed assessment against <br /> such businesses shall be taken for a period of one (1) year from the date of the finding of <br /> a majority protest by the Council. <br /> All 40 lodging businesses proposed to be included in the district were sent notice of the <br /> public hearings and the City's intention to adopt a Resolution Renewing the Tri-Valley <br /> Tourism Marketing District effective July 1, 2022. <br /> Resolution Modifying the Management District Plan <br /> To complete the formal process of renewing the TVTMD, the Council would adopt a <br /> Resolution Declaring Results of Majority Protest Proceedings and Renewing the Tri- <br /> Valley Tourism Marketing District per the Management District Plan (Attachment 1). <br /> Amendment to PMC Chapter 5.36 <br /> As the City previously codified the assessment district in its municipal code, a separate <br /> ordinance amending the Pleasanton Municipal Code to reflect the changes to the <br /> TVTMD is being introduced to the City Council (Attachment 2).
