1 <br /> THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> pL£ASANTON <br /> April 19, 2022 <br /> City Attorney <br /> City Clerk <br /> City Manager <br /> TITLE: ADOPT FINDINGS REGARDING PUBLIC HEALTH RELATED TO THE <br /> COVID-19 PANDEMIC TO SUPPORT CONTINUED VIRTUAL PUBLIC CITY <br /> MEETINGS PER RESOLUTION NO. 21-1249 <br /> SUMMARY <br /> State law requires that City Council, commission and committee meetings be open for <br /> the public to attend and address decision-makers. With the COVID-19 pandemic, the <br /> Governor declared a state of emergency and allowed for virtual meetings. Subsequent <br /> new state laws continued to allow for virtual meetings. The City wants to return to in- <br /> person meetings for all commissions, committees and subcommittees as soon as that <br /> can be done safely. Until then, State law (AB 361 of 2021) requires the City to make <br /> findings regarding the public health emergency to continue at least some virtual <br /> meetings. The Council adopted such findings on October 5, 2021 by Resolution No. 21- <br /> 1249, again on November 2 and December 7, 2021, as well as on January 18, February <br /> 15, and March 15, 2022. <br /> RECOMMENDATION <br /> Adopt by minute order the following findings: <br /> 1. City meetings are still not able to provide for six feet of separation between <br /> persons due to the small size of many meeting rooms, challenged by the large <br /> membership of some commissions and committees; <br /> 2. Ventilation, filtration and indoor air quality recommendations cannot be achieved <br /> in all City meeting rooms. <br /> FINANCIAL STATEMENT <br /> No effect.
