9.23.010 <br />(Pleasanton Supp. No. 27, 1-22) 258 <br />Chapter 9.23 <br /> <br />ORGANICS REDUCTION AND RECYCLING <br /> <br />Sections: <br />9.23.010 Purpose and intent. <br />9.23.020 Adoption. <br />9.23.030 Local amendments. <br />9.23.040 Severability. <br /> <br />9.23.010 Purpose and intent. <br /> Comply with state laws requiring cities provid- <br />ing waste collection services to adopt ordinances and <br />take other measures to reduce the amount of organic <br />and recyclable materials deposited in landfills from <br />commercial and residential generators pursuant to <br />the Short-Lived Climate Pollutants Organic Waste <br />Reduction regulations adopted pursuant to Senate <br />Bill 1383 (2016). <br /> Streamline the reduction and recycling process <br />for commercial and residential generators by opting <br />into the countywide organics reduction and recycling <br />Ordinance developed by the Alameda County waste <br />management authority. (Ord. 2226 § 2, 2021) <br /> <br />9.23.020 Adoption. <br /> The Alameda County waste management au- <br />thority’s organics reduction and recycling ordinance <br />(WMA Ord. 2021-02) is adopted in this chapter by <br />reference, to be effective in Pleasanton beginning on <br />January 1, 2022. (Ord. 2226 § 2, 2021) <br /> <br />9.23.030 Local amendments. <br /> The city adopts the following local amend- <br />ments to WMA Ord. 2021-02 as follows: <br /> A. The enforcement agency for the provi- <br />sions of Sections 5, 6, 8, 9, and 10, of the WMA <br />Ord. 2021-02 is the city, the WMA, and any other <br />designee of the city. The enforcement agency for the <br />provisions of Sections 7, 11 and 12 of the WMA <br />Ord. 2021-02 is the city, the WMA, the Alameda <br />County department of environmental health <br />(ACDEH), and any other designee of the city and <br />authorizes the city manager to enter into agreements <br />with WMA and ACDEH. <br /> B. WMA Ord. 2021-02 Section 4 is <br />amended to exclude the phrase, “Except Single- <br />Family Organic Waste Generators that meet the Self- <br />Hauler requirements in Section 10 of this Ordi- <br />nance.” <br /> C. WMA Ord. 2021-02 Section 6 subsec- <br />tion (c) is deleted; therefore “collection frequency <br />waiver” for commercial business generators is not appli- <br />cable in the city. <br /> D. WMA Ord. 2021-02 Section 10 subsection <br />(h) is deleted. (Ord. 2226 § 2, 2021) <br /> <br />9.23.040 Severability. <br /> The city declares that each section, subsection, <br />paragraph, subparagraph, sentence, clause and phrase of <br />this chapter is severable and independent of every other <br />section, subsection, paragraph, subparagraph, sentence, <br />clause and phrase of this chapter. If any section, subsec- <br />tion, paragraph, subparagraph, sentence, clause or phrase <br />of this chapter is held invalid, the city declares that it <br />would have adopted the remaining provisions of this <br />chapter irrespective of the portion held invalid, and fur- <br />ther declares its express intent that the remaining por- <br />tions of this ordinance should remain in effect after the <br />invalid portion has been eliminated.
