The cities of Dublin and Livermore, Town of Danville, and the counties of Alameda and <br /> Contra Costa, will each be paid a fee equal to 1% of the amount of the assessments <br /> collected within their jurisdiction to cover their costs of collection and administration. The <br /> City of Pleasanton will be paid a fee equal to 1% of the amount of the assessment <br /> collected in the city, plus 1°A) of the total assessment collected from all jurisdictions, to <br /> cover the costs of collection and administration. <br /> Per the MDP, Visit Tri-Valley will place up to 5% of all Tri-Valley Tourism Marketing <br /> District assessments received into a Contingency Fund. If there are contingency funds <br /> collected, they may be held in a reserve fund or utilized for other program, <br /> administration, or renewal costs at the discretion of the VTV board. <br /> DISCUSSION <br /> To begin the formal process of renewing the Tri-Valley Tourism Marketing District, on <br /> January 18, 2022, the City Council adopted both a Resolution of Intention to renew the <br /> business improvement district and a Resolution Requesting Consent from the Cities <br /> Dublin and Livermore, Town of Danville, and Contra Costa County. <br /> In each of the participating jurisdictions, the Resolution Granting Consent to the City of <br /> Pleasanton to be included in the TVTMD was approved as a consent item with no <br /> comment or discussion at the meeting. City staff has copies of the resolutions granting <br /> consent from each of the partner agencies. From the January 19, 2022, notice to all <br /> lodging businesses through the time of issuance of this report, no protest has been <br /> received by the City. <br /> The purpose of holding this public meeting on March 15, 2022, is to hear any protest to <br /> the renewal of the Tri-Valley Tourism Marketing District. All 40 lodging businesses <br /> proposed to be included in the district were sent notice of this public meeting and the <br /> April 19, 2022, public hearing to adopt a Resolution Renewing the Tri-Valley Tourism <br /> Marketing District effective July 1, 2022. <br /> As the City previously codified the assessment district in its municipal code, a separate <br /> ordinance amending the Pleasanton Municipal Code to reflect the changes to the <br /> TVTMD will also be presented to the City Council for consideration at its April 19 <br /> meeting. A second reading to adopt the ordinance will be on the City Council's May 3, <br /> 2022, meeting agenda. <br /> The ordinance defines the boundaries of the TVTMD, allows for the collection of <br /> assessments and provides the power to contract with a non-profit organization —Visit <br /> Tri-Valley—to carry out the marketing and promotion purposes for which the <br /> assessments are levied. The agreement between the City of Pleasanton and Visit Tri- <br /> Valley defines the roles and responsibilities of the parties in how district services are <br /> provided. To ensure there is financial oversight by the cities and counties, the <br /> agreement specifically requires Visit Tri-Valley to prepare and submit a fiscal year <br /> budget and an annual report, to each of the agencies, for each year in which <br /> assessments are levied and collected.
