Exhibit B <br />Conditions of Approval - PUD-34 <br />City Council <br /> June 15, 2004 <br /> <br />Planning <br /> <br />Development shall be substantially as shown on the development plans, <br />Exhibit "A", dated "Received April 29, 2004" on file with the Planning <br />Department, except as modified by the following conditions. Minor <br />changes to the plans may be allowed subject to the approval of the Planning <br />Director if found to be in substantial conformance to the approved exhibits. <br /> <br />This PUD shall be subject to the uses and site development standards of the <br />R-1-20,000 zoning district, except as shown in the following chart: <br /> <br />Principal Structure <br />MinimuTM Front Yard 30 ft. <br />Setback <br />Minimum Side Yard Setback 15 ft. (10 ft. on street side yard) <br />Minimum Rear Yard Setback 5 ft. <br />Maximum Height 15 ft. <br /> <br />The maximum floor area ratio for Parcel 2 shall be calculated using the net <br />buildable area (lot area on the south side of the berm/soundwall), <br />calculated on Exhibit A as 18,241 sq. ft. <br /> <br />The site plans submitted for the design review of the two custom homes <br />shall designate the front, sides, and rear yard areas on each lot, for review <br />and approval of the Planning Director, with the goal of orienting the front <br />of the home facing the hammerhead. <br /> <br />The developer shall pay any and all fees to which the property may be <br />subject prior to issuance of building permits. The type and amount of the <br />fees shall be those in effect at the time the building permits are issued. <br /> <br />The applicants shall agree to include the lots in the homeowners association <br />being created for the adjacent Clara Lane project.
