CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> ORDINANCE NO. 1907 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF TOM AND TRACEY <br />MH,LER FOR PUD DEVELOPMENT PLAN APPROVAL, AS FILED UNDER <br />CASE PUD-34 <br /> <br />WHEREAS, Tom and Tracey Miller have applied for PUD development plan approval to <br /> subdivide a 1.9- acre parcel into two single-family, custom home lots; and <br /> <br />WHEREAS, <br /> <br />an Environmental Impact Report was prepared and certified for the Vineyard <br />Avenue Corridor Specific Plan, and the California Environmental Quality Act <br />(CEQA) specifies that individual residential development projects that are <br />prepared pursuant to the requirements of an adopted specific plan, for which an <br />EIR has been prepared and certified, are exempt from additional environmental <br />review; and <br /> <br />WHEREAS, the Council received the Planning Commission's recommendations for approval of <br /> the development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 15, 2004; and <br /> <br />WHEREAS, <br /> <br />the City Council finds that the development plan and building design are <br />consistent with the General Plan, the Vineyard Avenue Corridor Specific Plan, and <br />the purposes of the PUD ordinance. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Approves Case PUD-34, the application of Tom and Tracey Miller, for PUD <br />development plan approval to subdivide a 1.9- acre parcel into two single-family, <br />custom home lots at 2562 Vineyard Avenue, subject to the conditions shown on <br />Exhibit "B," attached hereto and incorporated herein by this reference. <br /> <br />Section 2. <br />Section 3. <br /> <br />The City staff is directed to cause a Notice of Determination to be filed pursuant 1o <br />Section 5.4(g) of Resolution No. 77-66. <br /> <br />A summary of this ordinance shall be published once within fifteen (15) days after <br />its adoption in "The Valley Times," a newspaper of general circulation published <br />in the City of Pleasanton, and the complete ordinance shall be posted for <br />fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br />adoption. <br /> <br /> <br />
