RESOLUTION NO. 22-1274 <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF <br />PLEASANTON AND AVS RANCH, LLC., AS FILED UNDER CASE NO. PUD -138 <br />WHEREAS, AVS Ranch, LLC has made an application to the City for an Affordable <br />Housing Agreement for the construction of 22 single family residential homes on an vacant parcel <br />known as APN 949-16-6, and as filed under Case No. PUD -138 (the "Project"); and <br />WHEREAS, the Pleasanton Housing Commission reviewed and recommended approval <br />of the Affordable Housing Agreement for the Project at its meeting of June 10, 2021; and <br />WHEREAS, a duly -noticed public hearing was held by the City Council on February 15, <br />2022 at which time the public was given the opportunity to comment on the Affordable Housing <br />Agreement; and <br />WHEREAS, the prepared Initial Study/Consistency Checklist found that the Project is <br />consistent with the 1998 HVSP FEIR, listed mitigation measures identified in the 1998 HVSP <br />FEIR that apply to the Project, and determined that no further environmental review is required; <br />and <br />WHEREAS, the City Council considered all the information presented at the public hearing <br />regarding the terms of the Affordable Housing Agreement. <br />NOW, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br />PLEASANTON DOES RESOLVE, DECLARE, DETERMINE, AND ORDER THE FOLLOWING: <br />SECTION 1. Finds that the proposed Affordable Housing Agreement between the City of <br />Pleasanton and AVS Ranch LLC. is consistent with the City's General Plan and the objectives of the <br />City's affordable housing polices, including fulfilling the requirements of Municipal Code Chapters <br />17.40 Affordable Housing Fees and 17.44 Inclusionary Zoning. <br />SECTION 2. Approves the Affordable Housing Agreement between the City of <br />Pleasanton and AVS Ranch LLC., a copy of which is attached hereto as Exhibit A and <br />incorporated herein by this reference; and authorizes the City Manager to execute the Affordable <br />Housing Agreement in generally the form attached as Exhibit A, subject to minor amendments <br />and the approval by the City Attorney. <br />SECTION 3.
