Resolution No. 22-1275 <br />Page 2 of 2 <br />SECTION 3. The City Council finds that vacation of said right-of-way easement is <br />consistent with the California Streets and Highways Code Division 9, Part 3, Chapter 4 "Summary <br />Vacation" (§8330-8336). Specifically, the City Council finds: <br />(1) The portion of Road 16-6 right-of-way easement separating historic Lots 12 and 13 from <br />Lots 14 and 15 as shown on the 1896 Rancho Del Valle de San Jose subdivision map, <br />which right-of-way easement was accepted by Alameda County in 1926 is vacated. <br />(2) This resolution is prima facie evidence of the facts stated herein. <br />(3) That from and after the effective date of this resolution, the public right-of-way herein <br />described no longer constitutes a street, highway, or public service easement. <br />(4) The City Clerk shall cause a certified copy of this resolution of vacation to be recorded, <br />either as a separate instrument or as a statement on the final map for Tract 8616. <br />SECTION 4. This resolution shall become effective on the same date as the ordinance <br />adopting the Planned Unit Development Plan for AVS Ranch, PUD -138. <br />SECTION 5.
