Resolution No. 22-1275 Page 2 of 2 SECTION 3. The City Council finds that vacation of said right-of-way easement is consistent with the California Streets and Highways Code Division 9, Part 3, Chapter 4 "Summary Vacation" (§8330-8336). Specifically, the City Council finds: (1) The portion of Road 16-6 right-of-way easement separating historic Lots 12 and 13 from Lots 14 and 15 as shown on the 1896 Rancho Del Valle de San Jose subdivision map, which right-of-way easement was accepted by Alameda County in 1926 is vacated. (2) This resolution is prima facie evidence of the facts stated herein. (3) That from and after the effective date of this resolution, the public right-of-way herein described no longer constitutes a street, highway, or public service easement. (4) The City Clerk shall cause a certified copy of this resolution of vacation to be recorded, either as a separate instrument or as a statement on the final map for Tract 8616. SECTION 4. This resolution shall become effective on the same date as the ordinance adopting the Planned Unit Development Plan for AVS Ranch, PUD -138. SECTION 5. The City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.
