THE CITY OF <br />PLEASANTON. <br />14 <br />CITY COUNCIL AGENDA REPORT <br />March 1, 2022 <br />Community Development <br />Planning Division <br />TITLE: APPEAL OF THE PLANNING COMMISSION'S DENIAL OF DESIGN <br />REVIEW APPLICATION (P20-1053) TO CONSTRUCT A NEW 1,069 - <br />SQUARE -FOOT TWO- STORY RESIDENTIAL UNIT BEHIND AN <br />EXISTING COMMERCIAL BUILDING LOCATED AT 218 RAY STREET <br />SUMMARY <br />The subject application is an appeal of the Planning Commission's denial of Design <br />Review application (P20-1053) to construct a new 1,069 -square -foot two-story <br />residential unit behind an existing commercial building located at 218 Ray Street. The <br />Planning Commission denied the application on the basis the project is deficient by one <br />parking space and the Commission did not recommend the City Council approve an in - <br />lieu agreement and payment for that parking space. The denial was subsequently <br />appealed by the applicant. The applicant/appellant has cited adjacent neighbor support, <br />revised the allocation of parking spaces on site such that the in -lieu parking agreement <br />for one space is for the commercial portion of the building, reiterated the City's prior <br />approval of additional units on the subject site in 2002, and offered use of his private <br />parking lot by the public during weekends. Staff requests the City Council consider the <br />additional information provided by the applicant and review the subject application, <br />including consideration for approval of an in -lieu parking agreement, if the City Council <br />upholds the appeal. <br />RECOMMENDATION <br />Staff recommends the City Council: <br />1. Adopt the attached resolution (Attachment 1), making the criteria for PMC <br />Section 18.20 (Design Review), approving the appeal and application P20-1053, <br />subject to the attached conditions of approval. <br />2. Approve the associated in -lieu parking agreement (Attachment 2), approving an <br />in -lieu payment for one parking space. <br />FISCAL IMPACT <br />The project is expected to incrementally increase the demand on City services but is <br />also expected to generate additional property tax revenues. The applicant will also be <br />required to pay Development Impact Fees (e.g., Capital Facility Fee, traffic fees, <br />water/sewer connections, etc.) to offset the cost of City infrastructure necessitated by <br />the development. <br />
