Said improvements shall avoid removing <br /> above-ground utilities, and existing landscaping extended from residential <br /> properties into the existing right-of-way, where possible. The improvements shall <br /> start at the northern boundary of the project site traveling north until it meets <br /> Sycamore Road. The improvements shall be constructed by the applicant in <br /> conjunction with the Project subdivision improvements, but if delayed for any <br /> reason outside the control of the Applicant said delay shall not result in a delay <br /> to the Project. For example, should any property or easement acquisition be <br /> necessary to construct the improvements, then said acquisition shall be the sole <br /> responsibility of the City and shall not delay the Project subdivision <br /> improvements. The applicant shall receive credits for the approved costs to <br /> design and construct the improvements per City standards and subject to Cal. <br /> Labor Code §1720 et. seq., against the Capital Facilities Fee and Transportation <br /> Development Fee otherwise due, up to the total amount of such fees at the time <br /> of their required payment, through a fee credit agreement as provided in PMC <br /> §§3.22.060 and 3.26.070. If design and construction costs of the improvements <br /> exceed the fee credits, the applicant shall be responsible for such costs not to <br /> exceed the fee credits plus 11% of the credits; and applicant shall be repaid for <br /> approved costs that exceed 11% of the credits by a reimbursement agreement <br /> as provided in PMC §19.40.060. (PROJECT SPECIFIC CONDITION) <br /> 19. PARKING: A minimum of three parking spaces shall be provided for the primary <br /> residence. A minimum of four on site visitor parking spaces shall be provided <br /> with ample on site turn around space eliminating the need for vehicles to back <br /> out onto the public right of way.(PROJECT SPECIFIC CONDITION) <br /> 20. PARKING FOR ADU: One parking space shall be provided for the ADU. <br /> (PROJECT SPECIFIC CONDITION) <br /> 21. FIREPLACES: All new indoor and outdoor fireplaces or similar appliances shall <br /> be an electrical fireplace. (PROJECT SPECIFIC CONDITION) <br /> 22. OPEN SPACE MANAGEMENT PLAN: A site-specific Open Space Management <br /> Plan shall be submitted and is subject to review and approval by the City <br /> Attorney's Office and Fire Marshal prior to recordation of the final map. The plan <br /> shall address agricultural operations, open space maintenance, and wildlife and <br /> vegetation preservation needs. The plan shall also include a Wildland Fire <br /> Protection Plan component. (PROJECT SPECIFIC CONDITION) <br /> 23. CONDITIONS OF APPROVAL: The applicant shall provide all initial buyers with <br /> copies of the final project conditions of approval. (PROJECT SPECIFIC <br /> CONDITION) <br /> 24. BUILDING SURVEY: The applicant shall submit a building survey and/or record <br /> of survey and a site development plan in accordance with the provisions of <br /> Chapter 18.68 of the PMC. These plans shall be approved by the Chief Building <br /> PUD-138 and VTM 8616 Planning Commission <br /> Page 7 of 30 <br />
