THE CITY OF 3 <br /> rY ' "` CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON <br /> March 1, 2022 <br /> Community Development <br /> Planning Division <br /> TITLE: ADOPT A RESOLUTION APPROVING A PREANNEXATION AGREEMENT <br /> WITH KEVIN NGUYEN AND ELEANORE YEE FOR WATER AND <br /> SANITARY SEWER CONNECTIONS TO AN EXISTING RESIDENCE <br /> LOCATED AT 720 MOCKINGBIRD LANE IN UNINCORPORATED <br /> ALAMEDA COUNTY <br /> SUMMARY <br /> Kevin Nguyen and Eleanore Yee, property owners of 720 Mockingbird Lane in the <br /> Happy Valley area in unincorporated area of Alameda County, are requesting <br /> connections to the City's water and sanitary sewer systems. Prior to allowing properties <br /> outside the Pleasanton city limits to connect to City utilities, the City requires the <br /> property owners to enter into a preannexation agreement. If the preannexation <br /> agreement is approved, a party (the City, the County or the property owners) must apply <br /> for and receive an out-of-area service agreement from the Alameda County Local <br /> Agency Formation Commission (LAFCo). The Livermore-Amador Valley Water <br /> Management Agency (LAVWMA) may also require approval of the water connection. <br /> RECOMMENDATION <br /> 1 . Approve the Preannexation Agreement between Kevin Nguyen and Eleanore Yee <br /> and the City of Pleasanton, subject to modifications approved by the City Manager <br /> and City Attorney, and authorize the City Manager to execute the agreement. <br /> 2. Authorize staff to file an application with LAFCo for the extension of water and <br /> sanitary sewer services to this property and authorize staff to seek LAVWMA <br /> approval, if needed, of the water connection. <br /> 3. Authorize connection of 720 Mockingbird Lane (APN 949-6-1-6) to the City water and <br /> sanitary sewer system, provided: all connection work is done to the satisfaction of the <br /> City Engineer; all costs are borne by the property owner; and the proposed extension <br /> of City services is approved by LAFCo, and LAVWMA, if needed. <br /> FINANCIAL STATEMENT <br /> The property owners would be required to pay all costs associated with extending the <br /> water and sanitary sewer service, including City, County, and LAFCo permitting costs, <br /> and other agency fees, connection charges and meter fee. <br />
