Introduce and waive first reading of Ordinance No. 2228: (1) approving amendments to Chapters <br /> 18.32, 18.84, 18.88, and 19.16, and (2) creating chapter 18.101 of the Pleasanton Municipal <br /> Code to implement Senate Bill 9 regarding two-unit housing developments and urban lot splits <br /> into single-family residential zones; and consider adoption of a Resolution No. 21-1260 <br /> modifying the master fee schedule to incorporate new application fees <br /> Senior Planner Shweta Bonn stated this item is to review draft amendments to the Pleasanton <br /> Municipal Code (PMC) due to Senate Bill 9 (SB 9), receive public comments, introduce an ordinance to <br /> amend the PMC, and adopt a resolution to establish application fees for SB 9 projects. <br /> Senior Planner Bonn reported SB 9 allows for additional units on a parcel zoned for single-family use <br /> and urban lot splits and takes effect on January 1, 2022. To be eligible the parcel must be zoned for <br /> single-family use, not be in areas subject to natural hazards or other sensitive areas, be unoccupied for <br /> at least three years, not located in a historic district, and does not involve demolition of more than 25% <br /> of existing exterior structural walls. She added with no urban lot split, a parcel can have up to two <br /> Housing Dwelling Units (HDU), and up to two Accessory Dwelling Units (ADU) or Junior Accessory <br /> Dwelling Units (JADU). With an urban lot split, up to two parcels is possible with up to two HDUs each. <br /> Senior Planner Bonn reported each HDU must be at least 800 square feet with four-foot side and rear <br /> setbacks, meeting objective design standards. The City must approve SB 9 housing units ministerially <br /> with an opportunity to deny only if the development would have a "specific adverse effect" on public <br /> health or safety or the environment. If there is an urban lot split, one of the two HDUs can have an <br /> owner-occupancy requirement and the applicant must sign an affidavit indicating intent to occupy one <br /> of the HDUs for at least three years. No short-term rentals are permitted, up to one off-street parking <br /> space may be required unless it is near transit, a Homeowners Association can impose restrictions, and <br /> there is a prohibition in subdivisions of off-site improvements or requiring the dedication of land for <br /> right-of-way. <br /> The PMC will be modified to create Chapter 18.101 with definitions and objective standards specific to <br /> SB 9 units. She reported each unit must have individual utility connections and meters along with <br /> meeting code requirements for separate sales. She listed standards for urban lot splits. There would be <br /> a maximum height of 15 feet for buildings outside of the zoned building envelope. She listed proposals <br /> for objective design standards.
