CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 04-048A RESOLUTION CERTIFYING THAT CITY ASSESSMENTS COMPLY WITH PROPOSITION 218 WHEREAS, every year cities (and some special districts) throughout Alameda County request the County to place on the property tax rolls taxes and assessments that the cities and the special districts have levied; and WHEREAS, because of Proposition 218 concerns, the County Auditor has requested the requesting agencies (1) to certify that the taxes and assessments that are to be placed on the 2004/2005 tax roll meet the requirements of Proposition 218, and (2) to indemnify the County should there be a challenge to the tax or assessment on grounds that it doesn't comply with the requirements of Proposition 218; and WHEREAS, because City staff has discussed these various assessments at length with the City Council in context of Proposition 218 and because the Council has taken action to continue to levy these various assessments, the City is satisfied that the assessments that it has requested the County to place on the 2004/2005 tax rolls meet the requirements of Proposition 218. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1: The City Council certifies to the County of Alameda that the assessments that the City will request the County to place on the 2004/2005 tax roll meet the requirements of Proposition 218 and that the City Attorney is authorized to sign the attached Certification and Indemnification Agreement. Section 2: This resolution shall become effective immediately upon its passage and adoption.
