2. Approval of the CUP with modifications. The Planning Commission could approve the CUP, <br /> but with modified hours of operation for any permanent outdoor dining areas, or other <br /> changes to the proposal. <br /> Staff is able to support the findings to approve the proposal, as proposed, and believes the <br /> proposal would not adversely impact any existing on-site uses or the surrounding area; thus, <br /> staff suggests neither of the two project alternatives above should be pursued. <br /> PUBLIC NOTICE <br /> Notices of this application were sent to surrounding property owners and tenants within a <br /> 1,000-foot radius of the site. Staff has provided the location and noticing map as Exhibit E for <br /> reference. At the time this report was published, no public comment was received by staff. <br /> ENVIRONMENTAL ASSESSMENT <br /> This project is categorically exempt (Section 15301, Class 1, Existing Facilities) from the <br /> requirements of the California Environmental Quality Act (CEQA). Therefore, no environmental <br /> document accompanies this report. <br /> CONCLUSION <br /> Staff believes the required CUP findings for the proposal can be met if the proposal is approved <br /> as conditioned. Existing and new conditions of approval would remain in effect for the existing bar <br /> and/or have been included which would ensure the safety and general welfare of the <br /> surrounding area is maintained, while minimizing spillover effects such as noise. Staff believes <br /> with this condition, any permanent outdoor dining area would not negatively effect surrounding <br /> uses, including any nearby residential uses. <br /> ALTERNATIVES <br /> As articulated above, staff believes the proposal to allow permanent outdoor dining, including <br /> outdoor consumption of alcohol, for the existing bar, as conditioned, is consistent with the <br /> objectives of the zoning district. However, alternatives that could be considered by the <br /> Planning Commission include: <br /> 1. Denial of the application.
