California Environmental Quality Act (CEQA) Guidelines Sections 15182(a) (Projects <br /> consistent with a Specific Plan) and 15183 (Projects Consistent with a Community Plan <br /> or Zoning) mandate that projects consistent with the development density established <br /> by existing zoning, community plan, or general plan policies for which an FEIR was <br /> certified (in this case, the HVSP FEIR and the 2009 City of Pleasanton General Plan <br /> 2005-2025) shall not require additional environmental review, except as might be <br /> necessary to examine whether there are project-specific significant effects that are <br /> peculiar to the project or its site. <br /> An Initial Study/Consistency Checklist (Attachment 6) was prepared to determine <br /> whether and to what extent the 1998 HVSP FEIR addresses the potential impacts of the <br /> proposed project.4 Although no circulation period is required for this type of checklist, <br /> the City has made the document available on the City's website and notified interested <br /> parties and neighbors of its availability in advance of the Planning Commission meeting. <br /> Where appropriate, the checklist identifies current Best Management Practices (BMPs) <br /> that would enhance the effectiveness of mitigation measures from the 1998 HVSP FEIR <br /> applicable to the proposed project. The Initial Study/Consistency Checklist found the <br /> proposed project to be in conformance with the analysis and conclusions of the 1998 <br /> HVSP FEIR. <br /> This determination supports the approval of the proposed project and is based on the <br /> following criteria: <br /> 1. There are no new significant effects peculiar to the proposed project or its site; <br /> 2. There are no new significant effects that were not previously evaluated in the <br /> 1998 HVSP FEIR; <br /> 3. There are no new significant off-site or cumulative impacts that were not analyzed <br /> in the 1998 HVSP FEIR, and <br /> 4. There are no adverse impacts that are more severe than those previously <br /> identified in the 1998 HVSP FEIR. <br /> If the City Council concurs with this assessment, the City Council should find that the <br /> Initial Study and consistency analysis for the project have determined it is consist with the <br /> HVSP, the HVSP FEIR, and eligible for the CEQA Guidelines Sections 15182 and 15183 <br /> procedures for project review and approval. <br /> CONCLUSION <br /> Staff finds the proposed development meets the General Plan and HVSP requirements <br /> in terms of density, open space easement dedication, trail connections, and vehicle <br /> circulation. The proposed design guidelines provide development standards and design <br /> criteria to ensure new homes would be designed suitable for the semi-rural <br /> neighborhood setting. The project, as conditioned, would help to implement the <br /> a Technical studies and preliminary environmental review were conducted in 2018 to evaluate a higher density 39 unit development <br /> on the same site.To the extent the 2018 data and analysis remain relevant, it is provided for informational purposes to aid in the <br /> analysis of the proposed project. <br /> Page 17 of 18 <br />
